- In variance with the services own recruitment policy, which outlines the correct vetting procedures to be carried out before a person is appointed in the service, the following vetting information was not available: 1. Five references contained no evidence of validation. 2. There were no references on file for two adults. 3. One reference was not available for one adult
- The above procedures were not carried out before five adults were appointed, assigned or allowed access in the service
- 1. The five references identified during inspection have now been validated. The date, method of validation, name of the person who validated the reference, and outcome have been recorded on each relevant staff file. 2. Two written references have now been obtained for each of the two adults identified during inspection. The references have been validated where required and placed on the relevant staff files. 3. The missing reference has now been obtained, validated where required, and placed on the adult’s staff file. (3) The registered provider will ensure that the full recruitment process is completed before any adult is appointed, assigned or allowed access to the service. A start-date approval section has been added to the recruitment checklist, requiring management sign-off before the adult commences. The registered provider will complete a staff file audit before any new adult begins work or has access to the service. The person will not commence until the required references have been received, checked, validated and recorded. A pre-employment checklist will be used for all future appointments to ensure that references are received and validated before any adult is appointed, assigned or permitted access to the service

- A review of documentation evidenced that the requirements of Regulation 9(2) had not been completed prior to a staff member being appointed, assigned, or allowed access to or contact with a child attending the preschool service as outlined above under point 2(a)(b). This was identified on a previous inspection on 27 February 2025, 21 May 2025, 24 September 2025 and 11 December 20225 and the actions submitted by the registered provider failed to address this non-compliance reoccurring. A submission to the National Regulation and Enforcement Panel by the Registered provider outlined measures they would take to ensure compliance under regulation 9. These measures were not observed to be in place on the day of inspection
- One adult who did not hold a qualification in Early Childhood care and education at level 5 or above on the national qualification’s framework was observed to be working directly with the preschool children on the day of inspection. This was identified on a previous inspection on the 21 May 2025 and the actions submitted by the registered provider failed to address this non-compliance reoccurring
- In a written response the registered provider stated:
- Attempts were made to source a reference from the most recent employer in early years. Record submitted to the inspectorate. The registered provider will make sure we to take references from previous creche employers. All employee files will be reviewed by our external agency to ensure that all files meet the required standard
- THe recruitment policy has been reviewed and updated to clearly state that no staff member may commence work or have access to children until all requirements under Regulation 9(2) are fully completed
- No staff member will be permitted to work directly with children unless they hold the required qualifications. All staff members have been informed of this

Assigned responsibility to a designated staff member (e.g. Safeguarding Officer/HR) to monitor compliance. Set up automated reminders for certificate renewal and outstanding applications. Updated the organisations safeguarding policy to reinforce mandatory certification requirements. Conducted staff awareness/training sessions on safeguarding compliance and documentation. (2) The required documents were in place and on file. However, the file was not clearly labelled (missing name tab), which led to it being overlooked during the check. The correct file was located and verified, confirming compliance. The file was immediately labelled correctly with the staff member’s name. All staff files were reviewed to ensure proper labelling and organisation

The Garda vetting for one staff member was saved on the service computer and had not been photocopied or filed in the staff folder. The files are now present in the appropriate staff folders. Staff documentation will be thoroughly checked and regularly reviewed to ensure compliance. All documentation will need to be checked and passed before employment begins or students start their placement. The registered provider has assured that they have reviewed and updated their Garda vetting policy

There was no record of employment on file for one staff member and significant gaps in the employment record of another staff member, therefore the requirement for international police vetting could not be determined

The missing references have now been obtained and added to the staff members personnel file A full review of all current staff files was conducted to ensure references are on file for every employee. A recruitment check list has been introduced which includes mandatory verification of two written references. Staff involved in recruitment will complete a refresher training on Tusla recruitment requirements and documentation standards. 2. The staff members references has now been retrospectively validated by directly contacting the referee All staff files have been reviewed to ensure references are properly validated and documented. Internal audits of staff files will be conducted quarterly to ensure ongoing compliance. A new step has been added to the recruitment process requiring all references to be validated via direct phone call and recorded using a standard reference validation form. (c) Both staff members were immediately removed from duties involving children until Garda vetting was completed and clearance received. A new system for Garda vetting is in place to speed up the process and reduce delays. Garda vetting has now been complete for both staff. All recruitment files must now be signed off by the service manager. A file audit will be completed every quarter. The service will follow the policies stating no staff member may start work until garda vetting is confirmed. (d) 1. International police vetting has been obtained. 2. The missing employment record has now been obtained and filed appropriately in the staff members file. All existing staff files have been reviewed to ensure employment records are on file. A personnel file checklist is now in place

- (1) (b) The service provider will ensure that a person in charge or deputy person in charge will always be on the premises. This will be achieved by ensuring that the rota always includes the person in charge or the deputy, throughout the day, to ensure the non-compliance does not re-occur. The rota will be organised to reflect the above position, and a photo is attached to demonstrate the corrective action. The rota was implemented immediately to demonstrate that the corrective action is achieved. The person in charge will ensure that either herself or the deputy are on the schedule each day. This corrective action is implemented immediately and demonstrated in the attached photo of the roster. The service recognises the non-compliance and has implemented the corrective action above. To avoid re- occurrence of the above non-compliance the service provider will ensure that herself or the deputy person in charge are always present and the schedule will be compiled with that in mind. (2) (c) The Garda vetting for all staff was applied for on commencement of employment by the service provider, failure to assess or update this resulted in the above non-compliance. I immediately addressed this non-compliance by applying for all staff vetting renewals last month on the same day, not only the one that wasn’t available. I recognise that there was no procedure identified by myself to address compliance until now. The service provider has set a reminder to renew vetting applications in advance of expiry and in accordance with the 3-year rule to achieve a measurable target. This will also be done to ensure any new staff have their vetting renewed after their initial start date. The vetting for all staff currently employed has been renewed and a reminder has now been set in advance of the expiry of the existing vetting to ensure the non-compliance does not re-occur. The goal is to avoid the non-compliance re-occurring, so by setting a reminder for the month prior to expiry the service provider will be reminded to renew the vetting for the staff currently employed. The above corrective actions have been implemented immediately, and evidence of the new vetting is attached along with the reminder. The service provider has renewed all vetting for staff currently employed in the service and in addition has set a reminder in advance of the expiry date of the renewed vetting to ensure that the non-compliance does not re-occur. (4) The service provider has an electronic copy of the level 5 qualification for the adult in question but did not have the hardcopy on site. The service provider has attached the qualification for evidence. The service provider has printed the electronic version and added it to the hardcopy file. The qualification is held electronically but will also be added to a hard copy folder in the creche. The goal is to avoid the non- compliance re-occurring, so by having access to the electronic version and the hardcopy the non- compliance should not re-occur. The above corrective actions have been implemented immediately, and evidence of the qualification is attached. The service provider will have a hard copy and electronic copy available for inspection

The college provided a summary of the qualifications and stated that these where in line with a level 6 QQI qualification. As required by the DCEDIY list of recognised qualifications. We have asked the staff member to apply to the DCEDIY for further clarification and share a copy upon receipt of the same
