- (2)(a)(b) One reference and validation was not available in respect of one adult and two references available for two adults had no evidence of validation. (2)(c) A Garda vetting record was unavailable for two adults, who worked at the service. On 3 March 2026, an Immediate Action Notice was issued to the registered provider, regarding the breach of Regulation 9. The senior area manager responded and stated that an application for Garda vetting had been submitted and that the two adults in question would have no access to the children. (2)(d) Police vetting was unavailable for one adult who lived outside of the state for longer than six consecutive months and it was not possible to determine if police vetting was required for two further staff members as there were gaps in the available curriculum vitae. (3) Seven adults employed did not have the correct procedures carried out prior to commencement of employment. This posed a possible risk to unsuitable adults having access to the children. (4) There was one adult working in the preschool service who did not have evidence of a qualification in Early Childhood Care and Education at level 5 or above on the National Framework of Qualification or a qualification deemed by the minister to be equivalent. Not having suitably qualified staff, may compromise the safety of the children
Provider's corrective action:
- The following response was received from the registered provider: Corrective and Preventive Action (2)(a)(b) A reference and validation for one adult was received and two validations were received for one adult. A second adult had two validations on one page. Going forward all validations and references will be obtained prior to staff commencing employment. (2)(c) Garda vetting has be en received for one staff member . One Garda vetting remains outstanding and this staff member will not work with the children until it is received . All Garda vetting will be obtained prior to staff commencing employment. (2)(d) Police vetting was applied for one staff member and two curriculum vitaes have been updated. The service will ensure that police vetting is obtained prior to commencement of employment and that no gaps are in the curriculum vitae. (3) Outstanding Garda vetting and police vetting has been applied for and the relevant paperwork has been submitted. The staff member with outstanding Garda vettin g will not work with the children. One staff member out on leave will update the curriculum vitae on return to work

- (2)(c) Garda vetting had not been acquired in respect of one of the childcare students before they were allowed access to the children. An immediate action notice (IAN) was issued to the service in relation to this on 4 February 2026. On the 5 February 2026, an adequate response was received from the person in charge to mitigate the identified risk. On 17 February 2026, a copy of the Garda vetting was sent to the early years inspector, dated 11 February 2026
Provider's corrective action:
- The student left the service and did not return until Garda Vetting was obtained. Garda vetting was applied for immediately and Garda vetting was issued on 11/02/2026. All staff took part in training and refreshing of policies and procedures. All staff took part in children first e- learning. All staff will book in with local County Childcare committee for next available Children first training. No students will be allowed on work placement until Garda vetting is secured and received. Both person in charge and deputy person in charge will have to sign off on student documents before placement can commence

- (2)(d) Police vetting had not been carried out in respect of the childcare student who had lived outside the state for a period exceeding six consecutive months. It is acknowledged that police vetting was subsequently acquired and sent to the offices of the early years inspectorate on 17 December 2025, by which time the student had finished their work placement
Provider's corrective action:
- Police vetting was difficult to acquire for the student but it was eventually attained. In future, police vetting will be acquired for students or staff who require it prior to their placement or employment

An Immediate Action Notice was issued to the service stating that the member of staff could not work in the service until Garda vetting had been obtained. The registered provider responded to the notice confirming that Garda vetting had been re-applied for in respect of the member of staff who would not work in the service again until it was completed

- (2)(c) Garda vetting for the member of staff has been reapplied for and received back from the Garda Vetting Bureau. A Garda vetting list containing all staff members has been formed with dates of last vetting and due dates for reapplication for vetting. This list has been placed on the office notice board and put into office / management diary. Reapplication dates for Garda Vetting on the above Garda Vetting list have been selected to ensure that the vetting process is completed in a timely manner, taking into account staff and management sickness or absence, delays in the vetting process etc

The adult is currently on work experience duties and is not counted in the ratio and is supervised by a qualified member of staff at all times. The service will ensure that all staff members have submitted a statement of results or Certification in the future and will follow the services recruitment policy
