- (3) The registered provider did not demonstrate that all the procedures specified in paragraph (2) were all carried out prior to new staff members commencing employment in the service. Police vetting disclosure certificates for one staff member were not available on file on Day 1 of the inspection but were presented on Day 2 of inspection
Provider's corrective action:
- The following corrective and preventive actions were submitted by the registered provider. Corrective and Preventive Action A police vetting certificate was not present for one staff member. The registered provider immediately requested the certificate from the staff member, and it was sent on the same evening. To prevent the non-compliance from re-occurring in the future, a checklist for the Tusla Staff files Folder has been developed and will be used when gathering all required documentation for any new staff members. The Staff Recruitment policy has been updated to include the requirement for Spanish employees before they commence employment

- The certificate is now in place to confirm the staff member held an award in Early Childhood Care and Education on the National Qualifications Framework. The service will ensure going forward all required certification of qualification will be in place in future in the service

- (d) The registered provider, through their CAPA stated that the service did not have police vetting as the staff member only lived overseas for 18 weeks. The registered provider stated that if a staff member has lived abroad for longer than 6 consecutive months, the service will make sure vetting is obtained. (3) The service will review staff files and have all paperwork in place before employment commences

- (2)(c) A Garda vetting disclosure certificate was not available for one staff member employed in the service and observed on the day of inspection working directly with the children. An Immediate Action Notice was issued to the registered provider, and it is acknowledged that an adequate response and the required documentation was subsequently promptly submitted to the office of the Early Years Inspector. (3) The Garda vetting procedure specified in paragraph (2) were not carried out prior to the commencement of one employee in the service
Provider's corrective action:
- The registered provider responded stating that the Garda vetting was secured on the evening of inspection and submitted to the office of the Early Years Inspectorate. The registered provider states that they will not employ staff before obtaining Garda vetting in the future

- 1.2. All required written and validated references are now available on file in the service
- The staff member in question is now working in the kitchen and is no longer working directly with the preschool children

- An audit of the qualifications on file for the staff working in the service was carried out by the manager. The audit revealed one of the staff had not completed all modules required to achieve a level 5 in Early Years Care and Education on the national qualifications framework. The manager brought this to the attention of the Inspectorate having reviewed the causal factors at recruitment stage. The manager provided a detailed plan to address the matter

- A detailed plan has been submitted to the inspector on plans to support the staff member in concluding all modules required to achieve a level 5 in Early Years Care and Education on the national qualifications framework
