- The registered provider did not notify the Agency in writing of the following changes; The number of children the service can accommodate at one time and the opening hours of the service. The service is registered to provide care to a maximum of 36 children, however on the morning of inspection there were 37 children present. The service is operating their service between 7:45am -5:30pm but is registered to operate from 8am-5:30pm. This was a non-compliance on the last inspection on 1 December 2024. The service has been referred into the Services Operating Outside of Registration Department (SOORS)
- The building has been regularised, and all required documentation has been submitted to SOORS. The service is currently awaiting an inspection from Building Control Management System (BCMS). The person in charge will follow up with BCMS every two weeks until the inspection is completed, and all correspondence and outcomes will be recorded to ensure the action is progressed to completion. No further preventive actions can be implemented at this stage, as the service is awaiting an inspection and outcome from BCMS. The person in charge will maintain regular contact with BCMS and monitor progress until the inspection has been completed and any recommendations arising are addressed

- The registered provider failed to notify the inspectorate of a change in the number of children attending the service. There were 38 children present in the service when the inspector arrived. An additional child arrived at 10.03am, increasing the number to 39. Staff informed the inspector that the max number on any given day was 9 in the Baby room, 19 in the Montessori room, and 12 in the Toddler room. The service is currently registered to cater for 37 children and as such was found to be operating outside of the terms of their registration
- The registered provider stated the following corrective and preventive actions: The service immediately reviewed children’s attendance numbers and checked their register. They contacted parents to confirm children’s holiday and attendance. The attendance records have been reviewed to ensure numbers remain within the required capacity. The service responded to the email from SOORS to ensure them they are now back within their required capacity. All bookings, holidays and changes to attendance will be double checked and confirmed in advance. The service will continue to monitor daily attendance numbers closely to ensure the setting remains within the required limits

- (1) The registered provider was observed to be operating outside of their registered numbers without the approval of Tusla. The service is currently registered to provide care to 48 children on a full day care basis and 52 children on a sessional basis. Sixty-five children were registered to attend on a full day care basis on day one and two of the inspection, this increased to sixty-seven children by day 3 of inspection as two new children commenced in the service. The following was observed; o On day one of inspection 60 children were observed to be present during the morning session. o On day two of inspection 62 children were observed to be present during the morning session and 60 were present for the full day. o On day three of inspection 58 children were observed to be present for the full day. A review of attendance records dated between January and April 2026 demonstrated that this is an ongoing practice for the service and documentation available indicated that further children are scheduled to begin attending in the coming months. This is an ongoing non-compliance for the service for which the service was escalated to the national registration enforcement panel however the registered provider has failed to put corrective actions in place
- Enrolment was ceased with immediate effect, and no further admissions are being accepted at this time. A managed reduction plan has been introduced to ensure the service operates fully within the registered capacity of 48 full day care places. These actions were treated as a priority and implemented without delay to restore compliance and ensure the service remains operating within its registered conditions at all times. Review and strengthening of the admissions and enrolment policy to ensure that registered capacity limits are strictly adhered to at all times. Introduction of monthly internal compliance audits, with oversight at provider level. A formal commitment that any future intention to vary registered numbers will be subject to prior application and written approval from Tusla

This situation will not arise again as children will only attend Mo’s Montessori within the operating hours of 9am-2pm and 1-4pm. Summary Comment The registered provider has addressed the non-compliance through the corrective and preventive action taken. On the day of inspection, the service was found to have change the service type provided to part-time, operating from 9:00am to 14:00pm. Staff members stated this change had been in operation since the 16th September 2024
- The registered provider submitted the following response: Corrective and Preventive Action A change of circumstances form was completed following the inspection and forwarded to Tusla. Any future changes will be submitted to Tusla prior to any changes in circumstances
