- (1)(3) It is acknowledged that the registered provider submitted a change in circumstance form to the Agency regarding a change to the person in charge with effect from 04 May 2026. However, the person in charge confirmed that they had been in their role since 09 March 2026 prior to approval of the change. This regulation was non-compliant on the last inspection on 14 January 2026. The corrective and preventive actions submitted by the registered provider did not prevent recurrence of this non-compliance
Provider's corrective action:
- (1)(3) Upon identification of the non-compliance, the Registered Provider reviewed the appointment process relating to the Person in Charge role and confirmed that the Change in Circumstances notification had not been submitted within the required timeframe. The relevant notification has now been submitted to the Agency and all records relating to the appointment have been updated to accurately reflect the approved change. A designated responsibility assigned to both the Registered Provider and the Management Team to review any proposed changes that may require notification to Tusla, including changes to the Person in Charge, Registered Provider details, service address or operating arrangements. A Change in Circumstances Register will be introduced to record proposed changes, the date the change was identified, notification submission dates, approval status and implementation dates

- (1)(3) The registered providers did not notify the Agency in advance of implementing changes to the service’s registered details. The person in charge on the service’s registered details does not work in the service. The manager identified themselves as the person in charge and confirmed that they commenced in their position on 10 November 2025. It is acknowledged that a Change in Circumstance form was submitted in the afternoon of the day of inspection to address this issue, however, it was not submitted prior to the manager commencing in their role. Acknowledgments The inspector wishes to acknowledge the cooperation of the person in charge, staff and children who were present on the day of the inspection

On the inspector’s arrival, the manager identified themselves as the person in charge

- A change in circumstances had been sent in to change in circumstances in January 2025. However, the approval hadn’t been received by the date of the inspection. Awaiting certificate of registration. A change in circumstances should be sent in prior to the change in the service

- (1)(3) The registered provider did not notify the agency in advance of implementing changes to the service’s registered details. The service is currently registered to operate a part-time service from 09:00 to 13:00. On the day of inspection, the registered provider confirmed that the service operates an afternoon part-time service from 12:30 to 16:30. The service has also changed their morning service hours to 08:00 to 12:00. This non-compliance was present on the last inspection on 20th January 2022. The corrective and preventive actions as stated by the registered provider did not prevent recurrence of this non-compliance
Provider's corrective action:
- An email with the change in circumstances form was sent to cic.eyi@tusla.ie. We received confirmation of change in circumstances on the 24/02/25 that the changes had been approved. The registered provider will always ensure that the agreed circumstances of operation are correct in terms of administration and operation

- A notification of change of circumstances form has been submitted to reduce the age profile of the children to 1-6 years with a maximum of 30 children attending

- (1) The Registered Provider was operating outside of the registration for the service as evidenced by the following observations: • There were six children aged 2 years 8 months - 6 years present and remaining in the service until 14:00 hours on day 1 of inspection. • There were eight children aged 2 years 8 months - 6 years present and remaining in the service until 14:00 hours on day 2 of inspection. The service is registered to provide sessional care in the morning (9:00 – 12:00 hours) and afternoon (12:15 – 15:15 hours) each day
Provider's corrective action:
- (1) A change in circumstances form has been submitted, detailing the issue around the affidavit for registration. For the purpose of registration an affidavit was submitted. I was not aware that in using this route, my service type was then unchangeable

Provider's corrective action:
- (1) The registered provider will ensure that the number of children never exceeds 20 at one time. An application for change of circumstances with required documentation has been submitted to the registration office. This application was closed on 12 December as planning permission has a condition which restricts the service numbers to 20 children
