- (a) The service did not have a named person to deputise as required

Provider's corrective action:
- (1)(a) The registered provider stated that a roster is in place for staff that are currently substituting for a current vacancy, and it will be made clear each day that whoever is substituting is the deputy person in charge. Management will ensure that each staff member is clear what their role is within the service and that this is reflected in the roster. (2)(a)(b) The registered provider stated that a written and verified reference for one adult was obtained and the manger will follow up on references and use the checklist in each staff member’s file to ensure all the required references are included and verified. Once a reference is received management will ensure that after it is validated that both the reference and the validation form are stored on the staff’s file

- (4) The registered providers did not ensure that all adults working directly with the children were appropriately qualified. The inspectors observed that one adult providing direct care to children in the Toddler room on the day of the inspection did not hold a qualification. Additionally, staff reported that the adult had provided relief cover in another care room on 24 April 2026. This regulatory requirement was non-compliant for this adult on previous inspections dated 29 May 2023,11 June 2024 and 30 June 2025.The preventive actions submitted following these inspections have not prevented the non-compliance from recurring
Provider's corrective action:
- The registered providers submitted the following corrective and preventative actions: The staff member is not permitted to work in ratio or provide unsupervised direct care to children. The individual will only work in a support capacity and will not be counted towards regulatory staffing requirements until an appropriate qualification is obtained and recognised. The staff member is currently on their fourth module and is scheduled to complete the course in October. The service has reviewed all room rosters to ensure that only qualified staff are assigned to positions involving direct care of children and counted in ratio. Relief and cover staff will not be assigned to rooms until their qualification status has been verified. Qualification compliance will be reviewed regularly by management and is included as part of the staffing and recruitment procedures

- (c) A Garda vetting disclosure had not been obtained for one staff member employed in the service. An Immediate Action Notice (IAN) was issued to the service on the 11 December 2025 in relation to Regulation 9- Management and Recruitment. (d) Police vetting was not available from one country in respect of one staff member who had resided outside the jurisdiction for a period of more than 6 consecutive months as an adult. (3) Documentary evidence was available to demonstrate that the procedures outlined in paragraph (2) had not been completed for three staff members prior to starting in the service and allowed access to the children
Provider's corrective action:
- (c) In response to the non-compliance the registered provider has stated that Garda Vetting has been obtained for the staff member and that the manager and administrator are aware that employees cannot start in the service until their Garda Vetting has been received. (d) In response the police vetting for the staff member has been received and translated into English. All police vetting documents from staff will be obtained before they start in the service. (3) All future staff will not be allowed to start in the service before we have received their Garda and police vetting. Owner, Manger and Administration staff member all agreed this action in our weekly meeting on 12th Dec 2025

- (4) Following a review of documentation available the inspector could not confirm that one staff member held a major award in Early Childhood Care and Education at Level 5 - 8 on the National Framework of Qualifications or a qualification deemed by the Minister to be equivalent
Provider's corrective action:
- (4) The registered provider stated that the staff member has applied to complete an appropriate course. As a preventive action the registered provider stated that all staff qualifications to be checked annually and that the Board must ensure that on future employment the staff members have the relevant qualification. Summary Comment The preventive action outlined by the registered provider to ensure this non-compliance does not re-occur has been accepted. However, in respect of one staff member the non-compliance remains outstanding as evidence that the staff member has an appropriate childcare qualification has not been submitted

- Corrective Action 2(a)(b) One written reference for one staff member was received and validated. This reference was also added to the staff folder. (d) International police vetting was requested and received. It was also added to the staff folder. Preventive Action 2(a)(b) The service will make sure to always receive and validate all staff references and add these to their staff folder. (d) The registered provider stated that they were not aware this was required. (4) The registered provider stated that a new fully qualified staff member will be starting in the service in the new school year

- Corrective Action A second written validated reference for 1 staff member was sent to the reporting officer later that day after inspection. Preventive Action The service will ensure that all references are cross checked, and two references are in place for each member of staff

- The service was found to be operating outside of its current registration status. The service is currently registered as a sessional service to provide care to 11 children aged 2-6 years between the hours of 9:30am-12:30pm. However, on inspection there were 3 children observed to be present between the hours of 12:30pm-1:30pm. An internal Tusla referral was made in relation to the service operating outside of its registered status
Provider's corrective action:
- The registered provider has stated that she will only operate the service between the hours of 9:30 -12:30 as per current registration, she will not allow children to stay beyond that time
