Regulation 8 — Notification of change in Circumstances

  • : (1) The registered provider failed to notify the Early Years Inspectorate of a change in circumstances in relation to the following as per the schedule 4 Form for Notification of proposed Change in Circumstances. On the morning of Inspection the service was operating outside the remit of its registration status as an additional room in the garden(Garden room) was being used as a care room without notifying the Early Years Inspectorate
Provider's corrective action:
  • submitted by the Registered Provider Corrective Actions (1) The Garden room will no longer be used as a care room but as an additional area for outdoor play. Preventative Action The registered provider will ensure no additional areas are used as care rooms or no changes are made to the operations of the service without notifying the Early Years Inspectorate. Evidence Submitted Response to the Immediate Action Notice by the registered provider was accepted by the Inspectorate. Summary Comment The inspector has reviewed and accepted the response of the registered provider in the Corrective Action and Preventive Action plan. Years Services) (Amendment) Regulations 2016 REF: EYIRIRFDC02-2017: Version 12: Mar 2021 1.0 TUSLA REGULATORY INSPECTION REPORT Regulation 30 Minimum Space Requirement A registered provider shall ensure that adequate clear floor space is available in the premises for the work, play and movement of children attending the pre-school service. (1) Subject to paragraphs (2) to (6), a registered provider shall ensure that adequate clear floor space is available in the premises for the work, play and movement of children attending the pre-school service. (2) A registered provider of a full day care service or a part-time day care service shall ensure that the minimum amount of clear floor space specified in column (3) of Schedule 7 opposite a particular reference number specified in column (1) of that Schedule in respect of the age range of children specified in column (2) thereof at that reference number is available for each child in that age range attending the service. Non-Compliance Information: (1) The registered provider did not ensure that adequate clear floor space was available in the Playgroup room from 11:50 am to 12:15pm to accommodate the children attending the service on a part-time /full day care basis. Corrective & Preventive Action submitted by the Registered Provider Corrective Actions Additional children were in attendance on the day of inspection who do not normally attend on that day. Preventative Action The registered provider will ensure that the number of children in the Playgroup room does not exceed 9 children attending on a part-time/ full day care basis. Evidence Submitted Children’s attendance records for the week of the 16/5/22 with the correct ratios maintained. Summary Comment: The registered provider in the Corrective Action and Preventive Action plan has addressed the non-compliance. This will be reviewed at the next inspection
