Regulation 23 — Safeguarding health, safety and welfare of child

  • General Safety: 1. Garda vetting was available for 5 adults, however, 1 of these vetting disclosures was not dated within the previous 3 years in adherence to the Early Years Inspectorate Regulatory Notice “EYI-RN12.3 Renewal of Garda Vetting” posing a potential safety risk for children.   • The following statement was received from the registered provider; General Safety: 1. Garda vetting has been renewed for this employee. A checklist of expiry of garda vetting disclosures is now in place to ensure that vetting is renewed before the expiry date

  • 1 (b) The number, type and maintenance of firefighting equipment service record expired in January 2024

Regulation 9 — Management and recruitment

  • (1)(c) One staff member working directly with children did not have the required vetting disclosure received from the National Vetting Bureau of the Garda Síochána in accordance with the Act of 2012. An Immediate Action Notice was issued to the registered provider on Monday 21st October 2024. (4) One staff member working directly with the children did not hold the recognised qualification or a major award in Early Childhood Care and Education
Provider's corrective action:
  • (1)(c)On Monday 21st October 2024 the registered provider advised that the person is no longer working directly with children. A new garda vetting application has been submitted to the vetting bureau for consideration. On Tuesday 22nd October the registered provider sent a copy to the Inspectorate of the vetting disclosure received. The Registered Provider advised that Manger will check Garda clearances twice yearly. (4) No response submitted from the registered provider to address this non compliance

Regulation 11 — Staffing levels

  • (2) The registered provider did not ensure, that at all times the minimum ratio of adults to children in respect to their age range was adhered to:- At 10:12am there was one staff member working directly with seven children in the purple pod room. There was a second member of staff required for the adult to child ratio. It is acknowledged that a second member of staff entered the room at 10:22am. At 10:30am one staff member was working directly with nine children in the green pod room. The second member of staff required for the adult to child ratios entered the room at 10:42am. Nine children aged two years and two months to two years and eight months were eating their morning snack at the time the staff member left the room leaving the inspector unaccompanied with the children. At 2.20pm there were three adults in the green pod room working directly the 25 children present. The fourth staff member required for the adult to staff ratios entered the room at 2.40pm. Provider's corrective action:
  • Two staff members were on sick leave on the day of inspection. In the future in such instances the baby room will be closed

These vetting disclosures were not dated within the previous three years in adherence to with the Early Years Inspectorate Regulatory Notice ‘EYI-RN12.3 Renewal of Garda Vetting’. Action submitted by the Registered Provider

  • Renewed garda vetting disclosures were submitted to the vetting bureau for the two staff members. Manager will review files twice yearly

Immediate action notice. On the 29th of November 2023, an immediate action notice was issued, for

Regulation 23 — Safeguarding health, safety, and welfare of child

  • General Safety: 1. Water temperatures recordings of 51.1°C to 50.5°C, taken between 12.50hrs, to 12.57hrs, from the hot water tap at the wash hand basin used by children aged 1 to 2 years of age, in the Purple room. These water temperatures were above the recommended 43°C upper safety limit to prevent a risk of scalding. It is acknowledged that once advised the registered provider checked the thermostat and organised a professional to investigate and rectify this high hot water temperature. It was also noted that the hot water temperatures from all the other hot taps in sanitary and playrooms were under the 43°C upper safety limits. Action submitted by the Registered Provider On the 29th of November and the 11th of December 2023, the registered provider advised of the following: General Safety:

  • 1. A professional plumber has rectified the h ot water temperatures from the hot tap in the Purple room. The plumber replaced the temperature control valve. Going forward all playroom water hot taps will be tested weekly to ensure safe water temperatures
