- (1)(a) The registered provider was the designated person in charge. On the 26/02/2026 there was no assigned deputy person in charge for the preschool service when the early years inspectors arrived. (b) The designated person in charge was not onsite during the morning of the inspection until approximately 10. 55. There were two adults working with the preschool children neither of whom were the deputy person in charge and had no access to the office which contained information required for the inspection. (c) There was no clear management structure in the service that identified the lines of authority and accountability in the service and the specific roles and responsibilities of each employee and unpaid worker. (4) One adult working directly with the preschool children, did not provide evidence of they had acquired one of the following: − A minimum award in Quality and Qualifications Ireland (QQI) at a Level 5 on the National Framework of Qualifications, in Early Childhood Care and Education or a qualification deemed by the Minister to be equivalent. − An exemption from the qualification requirement and confirmation that the Minister accepts this exemption. It was acknowledged that the registered provider advised that this adult without a childcare qualification or exemption worked pre-dominantly with school aged children
- 1. Evidence was not available that staff had completed their induction training: 2. Three staff members had not signed the declaration that they had read and understood the service policies and procedures to date. It was acknowledged that the staff had a team meeting on the 4/2/2026 and all staff were advised to complete induction training as soon as possible. 3. While documentation was available for staff probation assessments at one and five months, the registered provider advised these will be carried out at one, three, six and nine months. There was no evidence that any probationary assessments ha d been carried out to date on file . In addition , the documentation had a different service name. 4. The service did not comply with their own recruitment policy, which specified the procedure to be followed by the registered provider when hiring employees and unpaid workers, (including the steps to be taken to check qualifications and vetting documentation), prior to the employee commencing

- The following were acknowledged at regulatory compliance meetings on the 01/05/2026 and the 08/05/2026. • There was no roster in place identifying the management structures in operation on the day of inspection, but a staff roster has been implemented since the inspection. The registered provider stated all procedures specified in paragraph (2) will be carried out prior to any person being appointed. • It was stated they will comply with their own recruitment policy going forward

There was no nominated person in charge available during the operating hours of the service on the day of inspection or the 2 days previous, from Wednesday 12/11/2025 to Friday 14/11/2025 inclusive. (d) 2. One adult had worked outside the jurisdiction for longer than 6 consecutive months or more, while over the age of 18 years. The adult had lived and worked in another country on 2 separate occasions, evidenced on their curriculum vitae. There were no police vetting certificates on record for that adult
- 3. One adult working directly with children since the end of July 2025, did not hold one of the following: − A minimum award in Quality and Qualifications Ireland (QQI) at a Level 5 on the National Framework of Qualifications, in Early Childhood Care and Education or a qualification deemed by the Minister to be equivalent. − An exemption from the qualification requirement and confirmation that the Minister accepts this exemption. − The qualification requirement or relevant specialist training and the basis on which the capitation may be used for a person employed under the Access and Inclusion Model (AIM), detailed in an exemption letter from Pobal. (7)(a) The service did not comply with their own staff training policy, which specified that the registered provider, when hiring employees and unpaid workers will maintain verified references, qualifications and vetting documentation on file

- On the 23/12/2025 the registered provider advised of the following. Corrective and Preventive Action
- A new management system has been agreed. Roles of management have been clearly identified. A person in charge and a deputy person in charge had been agreed amongst the staff members. The registered provider will review the staff roster on a weekly basis to ensure there is a clear management structure in place. (d) 2. All curricula vitae will be reviewed to ensure exact dates are included for all employment histories. Audits will be carried out regularly in the childcare service to ensure compliance with vetting and recruitment documents. The staff member has ceased employment in the childcare service since the 17/11/2025
- A recruitment and compliance checklist has been implemented to confirm qualification s and exemptio n requirements have been met prior to employment in the service. Management will carry out regular audits of all staff files to ensure ongoing compliance with qualification, training and vetting requirements. Training has been provided to management on regulatory requirements regarding staff qualifications and ratio compliance. The staff member with no qualification has ceased employment since the 17/11/2025
- The service’s staff training and recruitment policy has been reinforced to ensure all qualifications, references and vetting documentation are verified and retained on file before staff commence employment. Training has been provided to management on regulatory requirements

(4) The registered provider did not provide evidence that 2 adults had acquired an award in Quality and Qualifications Ireland (QQI) at a Level 5 on the National Framework of Qualifications in Early Childhood Care and Education or a qualification deemed by the Minister to be equivalent. It was acknowledged on the day of inspection, that an application to have 1 of the staff member’s qualifications recognised was submitted to the DCEDIY

- The registered provider stated the following in their reply: All references are validated and on file for all staff members. We are awaiting one police vetting to be processed by the relevant bodies and we are awaiting police vetting for one adult to be translated. A copy of the award in Quality and Qualifications Ireland (QQI) at a Level 5 on the National Framework of Qualifications in Early Childhood Care and Education was received from the staff member. The application to have one of the staff member’s qualifications recognised that was submitted to the DCEDIY has yet to be processed and returned. We will conduct monthly audits on all staff files to ensure that each file contains all relevant information

Summary Comment It is acknowledged that the registered provider submitted a response to the non-compliances outlined under regulation 9, however it did not address the findings of non-compliance

An application has been made for international child protection certificate for the two states the adult worked in for longer than 6 months while over the age of 18 years. The adult has made a tracking log to follow up on the applications and a reminder system to ensure overseas police vetting is applied for well in advance in the service in the future when required. 2. The police vetting for one adult was translated and a copy maintained on file

Corrective and Preventive Action The unqualified adult no longer works in the service and has been removed from the roster. The service will ensure that only qualified adults work with children in the future

- There was no person in charge when the inspection team arrived at the service. The person in charge which was the manager or the deputy person in charge which was the registered provider were not on the premises. The staff members present stated they were unsure as to who was in charge in the absence of the named persons above. A staff member contacted the manager of the service and she arrived to facilitate the inspection, within 15 minutes. (c ) The service did not clearly set out the roles of authority and accountability in the service. On the day of inspection, the registered provider had not appointed an alternative person in charge in the absence of both the designated person and the deputy. On the day of inspection, the registered provider did not ensure that there was a staff file for all staff members working on the premises. Only 2 of the 8 staff files required were available. The registered provider submitted a copy of the 6 outstanding staff files via email on the 27th of June 2024. (2) (a)(b) Two written and appropriately validated references from their most recent employer or a reputable source were not available for six adults working in the service (d) While police vetting was available for 2 adults that had lived in a state outside of Ireland for more than 6 months, a certified copy from a reputable source was not provided in english. Vetting documents provided in a language other than english or Irish must be translated by a reputable source of translation. (4) Evidence of a childcare award in Early Childhood Care and Education at level 5 on the National Qualifications Framework was not available for 3 of the 7 adults working directly with children

- 09/09/2024 The registered provider’s response did not contain any corrective or preventive actions to address the findings

In the future, proof of Police vetting documentation will be required at interview stage and before candidate commences employment
