**Immediate action notice.** Immediate Action Notice Regulation 9(2)(c): An Immediate Action Notice was issued on 09.04 2025 as a mandatory Garda vetting disclosure was not available for one person who was present in the service on the day of the inspection, contrary to the National Vetting Bureau (Children and Vulnerable Persons) Act 2012.The staff member made an application for garda vetting on 01.04.2025 and the person in charge and registered provider made assurances that the adult would not be working in the service without due consideration of the Garda vetting disclosure.

**Immediate action notice.** • 16(1)(h)(i)(j)(k) Records in relation to a preschool service, • 19(1)(a) Health Welfare and Development of child, • 25 (1)(2) First Aid, and • 26 (1)(2)(4) Fire Safety. However, on inspection additional non-compliance which posed a risk was identified under

##### Regulation 9 — Management and recruitment

- There was evidence that the registered provider did not ensure that all staff were suitable and competent prior to employment as outlined: (2)(a)(b) Appropriate consideration had not been given to references prior to staff commencing work in the service as required. Five staff files had no validated references from previous employers or reputable sources. (2)(c) An Immediate Action Notice was issued on 09.04.2025, in response to the breach in regulation. (4) The registered provider did not ensure that four adults employed to work directly with the children in the service held at least a major award in Early Childhood Care and Education at level 5 on the National Qualifications Framework or a qualification deemed by the Minister to be equivalent

- (2)(a)(b) Validated references were submitted from previous employers. (c) A Garda Vetting certificate was submitted. (4) The registered provider assured the inspectorate that the four adults who did not hold the required qualification will train or leave the service

##### Regulation 15 — Record of pre-school child

- (c) A section was not available for recording the date when the child ceases attending the service

##### Regulation 16 — Record in relation to pre-school service

- (a) A record was not available of the information required under the regulation for five staff. (i) There was no staff roster available detailing staff who were on and off duty on a daily basis. It is acknowledged that staff present on inspection were signed in on the register. (j) Parental consent for temperature reducing medication was documented in the children’s enrolment forms and there was medication stored in its own packaging and out of reach of children as required observed by the inspector. In discussion with staff, they described rarely administering medication and always contacting parents first. There were no records, which are required to be maintained of medication administered to a preschool child in the service

- (1) (a) Curriculum vitae were submitted in relation to five adults employed within the service. (i) (i) A staff roster was submitted. The registered provider will display a roster on an ongoing basis. (j) (j) There were no current records available. The proposed medicine administration form with the requisite details was submitted to the early years inspectorate

##### Regulation 23 — Safeguarding health, safety and welfare of child

- General Safety: 1. Four staff member’s vetting disclosures were not dated within the previous three years in contravention of the Early Years Inspectorate Regulatory Notice ‘EYI-RN12.3 Renewal of Garda Vetting’. This poses a risk to the safety of the children in the care of the service. Administration of Medication: 1.There is one child attending the service who has an allergy and staff reported is prescribed an adrenaline autoinjector in the case of a severe allergic reaction. In discussion with staff, they describe that the adrenaline auto injector is stored in the child’s bag when they are in the service. This is in contravention to the service’s administration of medication policy, which states that medicine must be correctly stored in its own packaging out of reach of children. This poses a risk to the children attending the service. 2.A detailed care plan was not available for a child with a severe nut allergy. The lack of a care plan detailing signs to watch out for, measures to be taken, location of medication and staff roles, may hamper timely effective intervention in the event of a severe allergic reaction. An individual risk assessment is required. Action submitted by the Registered Provider

- General Safety: (1) The registered provider applied for renewed Garda Vetting certificates for the four adults as required. Garda Vetting will be reapplied for close to the 3 year expiry time. Administration of Medication: 1. The Emergency medication will be stored in a conspicuous place , out of reach of children. 2. A detailed personalised care plan is in place for the child who may require emergency medication, in the event of a severe allergic reaction

##### Regulation 25 — First aid

- (1) Discussion with staff and review of staff files highlighted that only one adult is employed with First Aid Responder (FAR) training in the service. This person was not available on the day of inspection This regulation requires that one adult with FAR training is immediately available to the children in the service

- One more member of staff will receive FAR training, to ensure that there is an adult with this training available at all times
