#### Inspection of 24 October 2025 — Inspection Report

**Immediate action notice.** An Immediate Action Notice was issued to the registered provider on the 24th of October 2025 during the inspection in respect of Regulation 9(2)(c), Garda Vetting. Correspondence was received from the service on the 28th of October 2025 which adequately mitigated the risk identified., the contents of which will be discussed in the body of the report.

##### Regulation 9 — Management and recruitment

- The registered provider did not ensure that three staff files containing the documents referred to in regulation 9 (2) and (3) were available on the day of inspection therefore full compliance could not be determined in respect of these files. From the three files reviewed the following vetting information was not available: • A complete employment history was not available for two adult's files. • (a)(b) Written validated references from past employers for two adults, or references from reputable sources in the case of a person who has no past employers. • Garda vetting was not available for one adult on the day; an immediate action notice was issued in respect of same. It is acknowledged in their response that the service stated they had removed the adult from working directly with the children until such a time as that Garda Vetting is received, therefore mitigating the risk identified
- It was confirmed that the procedures specified in paragraph (2) were not carried out prior to one staff member being appointed, assigned, or allowed access to or contact with a child attending the pre-school service. For two staff members, it could not be determined whether the procedures had been carried out, as a record of their start date was unavailable on the day of inspection

- (2)(3) Garda vetting submitted for one adult and received on the 14/11/2025. New checklists created to ensure vetting procedures are completed and start dates are recorded for all staff going forward. The registered provider has confirmed that no employee will work with children without vetting procedures being carried out in full, first

##### Regulation 9 — Management and recruitment

- A number of issues were identified with how the service manages safer recruitment processes as detailed below:
- • There were no references available in respect of one adult. • There was no evidence available to demonstrate that two references in respect of one adult had been validated by the registered provider
- It was not possible to determine whether there was a requirement for police vetting for two staff members as there was no record of experience on file. (3) The registered provider did not take appropriate measures to ensure that all adults were suitable to work in an early years service prior to their commencement. It is acknowledged that a past employer reference and a reference from a reputable source were available for one staff member however, there was no evidence available to demonstrate that these references had been validated by the registered provider

##### Regulation 23 — Safeguarding health, safety and welfare of child

- Infection Control: 1. The handwashing practices observed were inconsistent on the day of inspection and at variance with the policy in place in the service. In the Ladybug room children’s hands were not washed before their meal. 2. A nappy changing practice observed on the day of inspection in the service was contrary to the service’s nappy changing procedure and was inadequate for infection control purposes. A child’s hands were not washed following a nappy change. Action submitted by the Registered Provider

- Infection Control: At our monthly meeting we focused on our infection control, hand and toilet policy. A new bigger poster was made as a reminder for each room regarding when to wash hands
