Inspectors identified that the governance arrangements and management structure were inadequate, given the scale of the service, to ensure that risks were appropriately monitored and responded to. Following the previous inspection in February 2026, the actions submitted by the registered provider included the creation of three quality liaison posts to prevent a recurrence of non-compliance. However, on the day of the inspection the following was noted: 1. Following the previous inspection, the registered provider stated that management would regularly monitor to ensure sleep checks were completed correctly. The absence of this oversight contributed to an ongoing and increased risk to sleeping children. The findings regarding room temperatures, absence or inaccessibility of thermometers were consistent in each of the six rooms where children slept. Please refer to Regulation 23 Safeguarding health, safety, and welfare of child. 2. Procedures for recruitment were found to be ineffective during the previous inspection in February 2026. This included the absence of police vetting for four staff members. Measures to reduce the likelihood of this known risk re-occurring were not implemented effectively following the previous inspection. Please refer to section Regulation 9 Management and recruitment (2) (d). 3. The registered provider submitted assurances through the CAPA process that management would monitor any potential works required within the service. These checks were ineffective to reduce the likelihood of non-compliance reoccurring. Please refer to section Regulation 29 Premises(d). 4. Based on the layout of the service and the number and age of the children, management structures were ineffective to ensure effective governance of fire safety risk. Please refer to Regulation 23 Safeguarding health, safety and welfare of child and Regulation 26 - Fire Safety Measures. (2) (a)(b) While it is acknowledged that validated references were available in 16 files, a validated reference was not available for one staff member. This had been a previous non-compliance in February 2026 and April 2025. The corrective and preventive action submitted by the registered provider stated that a review of all staff files had been completed to ensure all relevant documentation was present. (d) See Statutory Notice section - Immediate Action Notice IAN 3261
Provider's corrective action:
The registered provider stated that: 1. A meeting was held with the liaison staff to emphasise the importance of regular sleep check logs, it was agreed that management and the liaison staff would regularly spot check sleep logs to ensure they are completed correctly and any irregularities are to be acted on immediately. A system to monitor the temperature for the office is to be installed. Digital thermometers were sourced and going forward the new monitoring system will support management to monitor safe sleep and react accordingly. 2. A full internal audit of the staff files was completed to ensure there will be no more discrepancies going forward. Going forward at interview stage, prospective staff will be required to provide information on previous work history and if they resided outside of this jurisdiction for six months or longer. This will ensure the required documentation is available for each staff. 3. Management have planned weekly meetings with maintenance personal for updates and a maintenance log has been created to record this. 4. In consultation with the fire officer all fire risk has been eliminated. Fire evacuation cots have been purchased. Weekly check swill be carried out to ensure all fire measures are in place
Regulation 19 — Health, welfare and development of child
1. Mealtime practices regarding equipment and materials were not aligned with the service healthy eating policy as follows: a. The tables and chairs in the Penguins room were not suitable for the age of the children. During dinner time on day 1, it was observed that the chairs were too big and eight children’s feet did not reach the floor. The tables were too high which contributed to three children being at the same height as the bowl with their dinner in it. The service policy stated that tables and chairs are suitable to children’s age and stage of development. b. Children in the Penguins, Jellyfish and Dragonflies rooms were observed to eat their 10am snack from the table. Plates were not provided for the children
Provider's corrective action:
The registered provider stated that: a. The table height has been reduced to ensure the children are comfortable and new chairs have replaced the old ones. b. Plates have been provided for all rooms and extra plates are available if required
Regulation 21 — Equipment and materials
Evidence of ongoing engagement with the Quality Mentoring programme was visible in the work that had happened since last inspection. However, there remained areas for development in the Penguins room and Messy Monkeys room: 1. There were insufficient supporting materials in the home corner in the Penguin’s room. This room caters for up to 20 children aged 2 to 2.5 years. In the home corner, there were 8 plastic food items which constituted the layers of a plastic beef burger and three real-life containers. Other supporting equipment was not available. Based on the number and age of the children, the equipment and materials available were insufficient. 2. The equipment and materials which were available to children who did not sleep in the Messy Monkeys room was not sufficient. Staff outlined that each day, the Messy Monkeys care room was sub-divided from 11.10am to 1pm to cater for up to five sleeping children. During this time, the upper section of the room was available for the 16 awake children aged 2.5 to 3 years to play in. There was a lack of resources during this time, as the equipment and materials in the lower section of the room were inaccessible. 3. The rest areas in the Penguins, Messy Monkeys and Rocking Racoons rooms were inadequately equipped to provide the children with a space to rest or retreat to during the day. The floor furnishing in the rest area was a thin foam material. Soft floor furnishings were required to provide comfort for children sitting or lying in the rest areas
Provider's corrective action:
The registered provider stated that: 1. More supporting equipment has been added to the Penguins room including real life containers and going forward they will ensure that real life equipment is replace regularly to ensure good quality equipment. 2. The sleeping arrangements have changed – children in Messy Monkeys room will now sleep in the Rocking Racoons room allowing children who do not sleep access to a room for play. The internal sleep room has been removed on the advice of the Fire Officer which allows more space for children to sleep in a dedicated area. 3. Penguin room now has an enhanced rest area if children require a break or a rest away from the main play area. These areas are being developed in the Messy Monkeys room and the Rocking Raccoons room
Regulation 23 — Safeguarding health, safety and welfare of child
General Safety: 1. Children in Starfish room were observed to use the toilet adjacent to an unlocked external door to the carpark. While it is acknowledged these children were supervised, the exit to the carpark was unsecured which posed a risk of a child leaving the building. 2. A review of 12 accident and incident records took place. Eleven of these records did not demonstrate that parents had been told about the incidents. 3. The flooring in the kitchenette area of the Dragonfly room was lifting creating a trip hazard. 4. There was a trailing cable within reach from a cot in the Caterpillar room where children under 2 years slept. This posed a risk of strangulation to a child. 5. There was an unfinished countertop edge in the Rocking Racoons room at a low level which had sharp edges. Based on the age and height of the children in the room, the countertop edge posed a risk of injury to a child. 6. The nappy changing table in the Jellyfish sanitary area was not suitable for the age of the children. According to the manufacturer guidance, the changing table was for the use with children up to 12 months. The children in the Jellyfish room were aged between 2.5 to 3 years. This posed an increased risk of a fall or an injury to a child. 7. The registered provider did not ensure that monitoring actions were in place following the previous inspection in February 2026 regarding pinch risks. Pinch risks were identified in a child safety lock in the Rocky Racoon room, an unsecured radiator cover in the Penguins room and the platform of a climbing frame in the garden. 8. The position of a cot in the sleep room between the Ladybirds and Cubs room posed an increased risk of children bumping their heads. The cot was located under a shelving unit. During both days of the inspection, children were observed to stand up in the cot at the same height as a section of the shelving unit. 9. A repair had been made to the cot in the Caterpillar room by affixing a piece of rigid plastic to the top bar. This hard plastic posed a risk of injury to a child. Infection Control: 10. The way in which beds were stored created a risk of the spread if infection. Throughout the two days, low level beds were observed to be stacked with the children’s individual bed sheets intact. This was observed before and after sleep in the Penguins, Messy Monkeys, Rocking Racoons and Jellyfish rooms. 11. Beds were stored in the sanitary area in the Messy Monkeys room. This posed an increased risk of cross contamination. 12. Hand washing and drying practices observed were inconsistent with the service’s infection control policy. These practices posed an increased risk of the spread of infection. The following was noted: • Handwashing following nappy changes and children’s toileting in the Messy Monkeys and Jellyfish rooms was carried out in the care room, despite a sink being present in the sanitary area. • Staff members used baby wipes to clean children’s hands and faces following dinnertime in the Penguins room on day 1. • A communal hand towel was in use in the Messy Monkeys room. 13. The toilet roll was stored on top of the toilet roll holder in the toilet in the Penguins room. Toilet roll which has been handled poses an increased risk of the spread of germs. 14. The procedures for drying of bed linen in the Rocking Racoons and Ladybird/Cubs rooms were unsuitable. On day 1, the 11 cots in the sleep room between the Ladybird and the Cubs room had bed linen drying on them. On day 1, in the Rocking Racoons room there was two clothes airers with bed linen in the care room and the sleep room. Due to increased moisture, this practice posed a risk of mould growth and respiratory illness. 15. The extractor fan in the sanitary area of the Dragonfly room was dusty with gathered lint and cobwebs. 16. Sweeping brushes were stored within the Penguins sanitary area. The storage of items in a sanitary area poses an increased risk of the spread of infection. Administration of Medication: 17. The administration of medication records did not include the required signatures. The inspector reviewed nine forms, of which only two included the parental signature to evidence that they had been informed that their child had received medication during the day. This procedure is required by the service’s medication policy Safe Sleep: 18. See Statutory Notice section in relation to Improvement Notice IAN3301 served. 19. See Statutory Notice section in relation to Improvement Notice IAN3303 served. 20. The procedures, as set out in the service’s safe sleep policy, were inconsistently carried out. During the two days of inspection, the sleep practices observed across the seven care rooms which catered for children aged 0-3 years posed a safety risk. The following was noted: a. The safe sleep policy stated sleep records were maintained, which included the recording of the temperature in the room. It outlined that a thermometer was in place to ensure that the appropriate room temperature was maintained while children slept. However, thermometers were fixed on a wall/ cabinet over sleeping children and could not be accessed by staff members or the early years inspector. On day 1, the thermometers in the Cubs/ Ladybird room cot room, Messy Monkeys cot room and Rocky Racoons care room were inaccessible. On day 1, the temperatures of the above sleep rooms exceed the recommended 18-22°c for children over 1 year as follows: • The room temperature was 23.2°c in the Ladybird/Cubs sleep room at 12.24pm while 12 children aged 1-2 years slept. • At 12.37pm, the sleep room temperature in the Messy Monkeys sleep room was 24.8°c while 6 children aged 2-3 years slept. • In the Rocky Racoons care room, the room temperature was 24°c at 12.59pm while 12 children aged 2-3 years slept. b. In discussion with staff members supervising sleep in Butterfly and Penguins cot rooms, they advised that the room was 18°c. However, the thermometer, which was accessible, was displaying temperature which exceeded the recommended sleep room temperature of 18-22°c for children over 1 year. • On day 1, at 12.05pm the temperature in the Penguins cot room was 22.9°c while four children age 2 to 3 years slept. • At 12.29pm on day 2, the temperature in the Butterfly cot room was 24.8°c while five children aged 1 to 2 years slept. It is acknowledged that the sleep room temperatures were maintained within the required range on day 2. 21. On day 1, in the Ladybird room, the staff member responsible for sleep checks did not enter the room where a child aged 1 years slept. They recorded that the room temperature was 18°c while the actual temperature of the room was 23.4°c. This was not in line with the service safe sleep policy which stated that staff members physically enter the sleep room or the Tusla guidance for the Early Learning and Care sector on sleep provision for children under 24 months. Fire Safety: Reasonable measures were not taken by the registered provider regarding fire safety within the service. The following was observed: 22. See Statutory Notice section in relation to Improvement Notice IAN3306 served. 25. The sleep room between the Ladybirds and Cubs rooms was overcrowded and posed an increased risk of a delayed response in the event of an emergency evacuation. In total, there was 13 cots in the sleep room for children aged 1.5 to 2 years. These cots were side-by-side with no space in between for staff members to easily access the children. General Safety: The registered provider stated that: 1. There is an external magnetic locked gate outside this exit preventing children from access in the car park in addition to ongoing supervision of children using the toilet. 2. A new online application is being installed which has a safeguard system to ensure parents have the capacity to sign these forms remotely 3. The flooring in the Dragonfly room has been removed. 4. The trailing flex has been secured, and cables will be removed or placed in conduit. 5. The countertop is no longer in use and will be fixed by the maintenance team. 6. The changing table has been removed. 7. A new safety lock has been installed; the radiator cover has been secured and the platform in the slide had been covered. The maintenance team will ensure equipment and materials are in good order. 8. The sleeping arrangement have been altered to allow one dedicated room for sleep creating more room for cots and staff can access the children easily. 9. The cot in question has been removed and replace with an evacuation cot. Infection Control: 10. Sheets are now stored in the children’s own baskets 11. Low beds are now stored in the dedicated sleep room – the Rocking Racoons room. 12. A meeting was held with staff reminding them of the services policy and procedures for hand washing and hand dryers are being installed in rooms. 13. Toilet rolls will be placed inside the casings moving forward. 14. Wet clothes will be air dried outside going forward. 15. Management will add checks of the air vents to the cleaning lists. 16. Sweeping brushes are now stored in the Penguins room. Administration of Medication: 17. The new parent online application will have the addition of a safeguarding system to ensure parents sign the medication form- this application is to be launched shortly. Safe Sleep: 20. Digital thermometers have been installed and a system where management can monitor the rooms temperature in real time. A temporary air conditioning unit has been installed to regulate the room temperature. A permanent solution is being sought regarding air conditioning units. Reflective foil has been put on windows to help with the temperature control. 21. Staff have been retrained in the Safe Sleep policy; this has been updated and displayed on each sleep room with ah check list to ensure the correct information has been recorded. Fire Safety: 25. The rooms have been reconfigured, and the Ladybird room is now a dedicated sleep room
Regulation 26 — Fire safety measures
(4) While procedures to follow in the event of a fire were displayed throughout the service these did not reflect the actual fire exit routes. In discussion with the registered provider, it was confirmed that the displayed evacuation routes for four care rooms on the first floor were not reflective of the actual rooms or the exit routes in place

Regulation 30 — Minimum space requirements
(1) There was insufficient clear floor space for the children in the Rocky Racoons room at times. The staff members explained that this care room was divided by a curtain each day between 12 to 2pm to facilitate the children to sleep. On day 2 at 1.50pm, there was 16 children aged 2-3 awake in the care room. Based on the age of the children, 37.6m2 clear floor space was required, however, only 32.07 m2 was available
Provider's corrective action:
The registered provider has stated that the internal room has been removed and this space in the Rocky Racoons room is now a dedicated sleep area to accommodate children’s sleep needs
Immediate action notice. An immediate action notice was issued on 5 February 2026 under Regulation 9: Management and Recruitment for the absence of a Garda vetting disclosure. The registered provider submitted a written adequate response on the 6 February 2026. The inspectorate requested that the registered provider attend a regulatory compliance meeting to address the outstanding findings of non-compliance.
Regulation 9 — Management and recruitment
(2) Forty-four staff files were reviewed; this included a student’s file who was present on work placement. In addition, Garda vetting for two staff members whose disclosures were identified as due for renewal was requested for review. (a)(b) Validated references were not available for four staff members. (c) It is acknowledged that Garda vetting was available for 43 staff members, and the service demonstrated compliance with the Early Years Inspectorate Regulatory Notice requiring services to renew Garda vetting every 3 years. The registered provider had not considered the vetting of a student before the commencement of their placement. An IAN was issued on the 2nd day of inspection, and a copy of the disclosure was provided to the inspectorate in response on 6 February 2026. (d) Police vetting was not available for four staff members who had lived outside the jurisdiction for a period for longer than six months
Evidence was not available for one staff member to demonstrate that they had achieved a major award in Early Childhood Care and Education at Level 5 on the National Qualification Framework or a qualification deemed by the Minister to be equivalent
Provider's corrective action:
(a)(b) The registered provider stated that one staff member was on leave and the required references would be sought once they return and a second staff would work off site until the references had been received. (c) The required Garda vetting was submitted to the inspectorate the following day 6 February 2026. The registered provider stated that they are currently doing a complete review of all staff files to ensure all correct and relevant documents are present. A checklist has been developed to ensure that Garda vetting will be completed in a timely manner. (d) The registered provider submitted evidence to demonstrate police vetting was sought for three staff members
The registered provider submitted a copy of the required certificate for the major award in Early childhood Care and Education at Level 5 on the National Qualification Framework. They stated that going forward all staff files would have a two person check and a staff profile checklist would be signed by both persons once complete. Staff files would be available on both hard and soft copies going forward
Regulation 21 — Equipment and materials
The environment within the sampled care rooms did not cater for the age and stage of development of the children attending. While it is acknowledged that the service continues to work with Better Start National Early Years Quality Development the environments in the rooms inspected have not yet been developed sufficiently to provide adequate play and work equipment for children. The rooms had limited resources to promote varied types of play, and the room layouts did not encourage independent play for children with limited areas of interests in care rooms. For example, the following was observed in the Jumping Jellyfish room, the Messy Monkey room and the Rocking Racoon room: • Open-ended and natural materials were not available to the children. • The play kitchens and play shops had no supporting equipment. • Empty shelving units with no material or equipment on them. • Plastic toys which could not function as there were no batteries. • The bookshelves had torn books. • Toys were stored in large deep inaccessible plastic buckets. Children's need for rest was not facilitated adequately, for example the following was observed: 1. The rest area in the Dragonfly room was not adequate for the 19 children in the room – there was only one small seat with no cosy furnishing or cushions. 2. There were no rest areas or cosy corners in the Rocky Raccoon room or the Messy Monkey room. The service sleep policy stated that children would have a quiet space to enjoy unstructured, quiet activities of their choice or have a rest with soft seating and matting areas to sit or lie down
Provider's corrective action:
The registered provider has stated that three Quality Liaison Persons (QLP), in conjunction with the staff have sourced open ended and natural materials particularly to accessorise the play kitchen and shops. This included empty food containers for imaginative play. A cosy corner had been developed for the Dragonfly room. The QLP’s have redesigned the children’s room to encourage independent play. The bookshelves have been reviewed. The QLP’s will continue to do regular checks in the rooms to ensure the quality is maintained and will give feedback to management
Regulation 23 — Safeguarding health, safety and welfare of child
General Safety: 1. In the Rocky Raccoon room, the large plastic tubs used to store toys were split causing a pinch risk for children. 2. The fixtures and fittings were not stable and sound, for example in the Dragonfly room a timber unit was not anchored securely and the shelf wobbled as the children leaned against it. Infection Control: 3. The nappy changing practice in the Penguin room and the Rocky Racoon room was not in line with the service infection control policy. The nappy changing procedure outlining each step was displayed in the nappy changing area. Staff did not wash their hands or the children’s hands after each nappy change. Aprons were not changed after each use and changing mats were not sanitised after each use. Staff were observed to walk around the care room wearing a disposable apron which was worn changing nappies. 4. Staff did not use the foot pedal on the bin to dispose of soiled nappies, touching the lid repeatedly may lead to cross infection. 5. Surface areas were not clean or maintained, soft matting in the Penguin room was visibly dirty, children and adult chairs in the rocky Racoon room were stained and crayon marks on the walls of the Starfish room. 6. Cots in the sleep room between the Ladybird room and the Cubs rooms were not placed 50cm apart and the low beds in the internal sleep room for children from the Rocky Racoon room were not 50cm apart creating a risk of cross infection. 7. A table which a staff member confirmed is used for crafting and snacks was covered with a non- wipeable porous material, it was visibly stained and created a risk for cross infection. Safe Sleep: 8. Through discussion with staff, it was identified that no record is kept of children’s position, colour or breathing. This was not in line with the services sleep policy which stated that children would be supervised and their colour, position and breathing checked every 10 minutes and this would be recorded on the application the service uses. 9. In the Penguin room at 13:20, 11 children under the age of 2 years were noted to sleep on low floor beds, these beds were not suitable for this age group as sleep facilities for this age group must be fitted with a firm mattress which is at least 6cm in depth. The registered provider stated that: General Safety: 1. The large containers have been removed and replaced with smaller suitable containers. All broken containers have been removed and replaced with wicker baskets for a more natural look and feel. 2. The unit in the Dragonfly room has been safely secured to the wall. The QLP’s will do regular checks to ensure there are no broken or unsuitable containers present, and these will be replaced as soon as possible. Any unstable structures will be replaced or secured, and all units will have regular maintenance checks. Infection Control: 3. A meeting was held with the staff of the Penguins room regarding the importance of following the correct nappy changing procedures. In addition, the nappy changing policy was discussed at the training day regarding procedures to be followed for the health and safety of the children, staff and visitors. Management will complete spot checks to ensure procedures are followed correctly 4. The correct use of the nappy bin was discussed at the training day as part of the nappy changing procedures. 5. Washable removeable covers have been placed on adult chairs and management will ensure these are washed regularly. 6. Cots in the Ladybird & Cubs Sleep room have been removed to allow for adequate space between them and the children can avail of an additional sleep room in the Caterpillar room. 7. A wipeable tablecloth has replaced the old one with additional ones available to replace damaged ones. Safe Sleep: 8. A sleeping log or each room has been developed which records each child’s colour position and checks which are to be carried out every 10 minutes. Management will complete regular checks to ensure sleep checks are completed correctly. 9. New beds have been orders for children under the age of two and management will ensure that all children under the age of two have either a low bed or cot to sleep
Regulation 29 — Premises
(d) The fixtures and fittings were not well maintained. For example: • The surface of the couches and cushions in the Dragonfly room and the Starfish room were ripped. • A wooden shelf in the Dragonfly room had rough exposed edges and screw holes. • The timber surface area of the doors in the sanitary area for the Starfish room was not finished, painted or sealed and appeared to be absorbent when wet. • There were exposed cabling and unfinished electrical work in ceilings of the Starfish room and the Rocky Racoon room. • In the rooms sampled, paint was chipped and surfaces not maintained or repaired as required, for example, in the Penguin room and Cubs room furniture had untreated timber exposed and chipped paint on the edges and there was a large hole in the radiator cover in the Starfish room. • A child’s toilet in the Messy Monkeys room was not working; this was a non-compliance in April 2025. At 15:09, two children were observed queuing to use the one toilet that was available to them
Provider's corrective action:
The registered provider stated that the couches have being removed from Dragonfly and Starfish rooms and replaced with new soft furnishings. A new enclosed cosy area has been created in the Dragonfly room, and this will be replicated in the following rooms: the Starfish room, the Rocking Raccoons room and the Messy Monkeys room. Management will ensure all soft furnishings are kept clean and of good standard by completing regular checks that coverings are washed regularly. The timber around surface area of the doors in the sanitary area have been painted and the timber and exposed edges have been covered with wipeable edging. Timber areas around the sanitary areas will be maintained and repainted when required. The toilet in Messy Monkey’s was replaced and management will ensure it is regularly maintained
Immediate action notice. An immediate action notice was issued to the registered provider on the 3rd of April 2025 regarding a non- compliance identified under Regulation 25, Fire Safety. The registered provider submitted an adequate response to the office of the Early Years Inspectorate on the 4th of April 2025 to demonstrate the actions taken to correct the non-compliance. A referral was made to the Chief Fire Officer on the 7th of April 2025 to assess fire safety regarding blocked fire exits. In consultation with the registered provider, the inspector has referred the service to the national early years quality development service, Better Start.
Regulation 9 — Management and recruitment
(a)(b) Of the 20 staff files reviewed, two verified references were available for 19 staff; however, a validated reference was not available for 1 staff member. (d) While it is acknowledged that police vetting was available for eight staff members who had resided outside the area for six months or more, evidence was not available to determine if police vetting was required for one staff member. (4) Evidence was not available to demonstrate that two staff members had qualified at the minimum level 5 or above on the National Qualification Framework or a qualification deemed by the minister to be equivalent
Provider's corrective action:
The Registered provider stated that all CVs are on file
The registered provider stated that evidence of a relevant qualification was received, and a staff member was waiting for the official certification. However, they stated that this staff member will not be counted in the adult- child ratio and will not be left alone with the children. The registered provider stated that a new employee checklist has been developed to ensure all documentation is on file prior to commencement of employment
Regulation 19 — Health, welfare and development of child
At times during the inspection, children’s learning, development was not facilitated. Basic needs: 1. Children's opportunities to engage in child-led activities were limited, and this was further restricted by the adult-led routine. For example: • Children were observed to sit in groups at four tables in the Messy Monkeys room with a staff member. Two tables had magnetic shapes, the third table had a farm and farm animals, and the fourth table had blocks. Children were not offered a choice in these activities. • Arts and craft materials were not available for the children to access independently. During • discussions with staff members, who explained that paints and crayons were available only as a planned activity. • A whiteboard in the Messy Monkey room listed the themes, including Mother’s Day, Easter and Spring and the number three. Staff described how songs and discussions based on the themes are introduced at ‘circle time’ but not included in activities during the day. Physical Environment: 2. Children had limited opportunities to experience and explore different textures and natural materials. The parents' handbook described the service’s curriculum as children learning through free play with a range of activities and diverse experiences. However, in the following four care rooms, the Caterpillar room, the Butterfly room, the Cubs room and Penguin room, there were limited textures and sensory activities available for the children as the toys were predominantly plastic. Regulation 20 — Facilities for rest and play
Children's basic sleep needs were not met in the Ladybird room as two children did not have access to cots when they showed signs of tiredness. The service’s sleep policy states that children under two will have access to a cot; however, there were an insufficient number of cots available for the number of children who required a sleep. Two children were held by staff and slept in their arms. It is acknowledged that the children were transferred to a cot once one became available
Provider's corrective action:
The registered provider stated that the staff have been retrained in the service’s sleep policy. Staff have been informed that if no cots are available for the younger children in the Ladybird room, children can avail of the additional cots in the other sleep rooms
Regulation 21 — Equipment and materials
The inspectors sampled eight rooms, including the Caterpillar room, the Butterfly room, Cheeky Monkey’s room, Rocking Raccoons room, Ladybird room, Cubs room, Penguins room and Jellyfish room. 1. There were limited areas of interest in the care rooms to engage the children in independent play. For example: • In both the Caterpillar room and the Butterfly room, equipment and furniture were situated against the wall of the room with no definite areas of interest laid out. • In the Messy Monkeys room, the large, deep shelving units and tables were against the walls with no areas of interest defined. • In the Ladybird room, the play kitchen was bare, with limited resources. • In the Rocky Racoon room, children's toys were stored on high shelves and were not accessible to the children. 2. The furniture, play and work equipment and materials in these rooms were damaged, worn and in some cases not suitable for use. For example: • Books in the Messy Monkey rooms were torn and had missing pages. • Large plastic blocks for building in the Messy Monkeys room had holes and were misshapen and, as a result, would not stack together. • In the Rocking Racoons room, stacks of jigsaws, dress-up clothes and construction materials were stored on high shelving with little choice of materials stored at the children's level. • The shelving in the Messy Monkeys rooms was sparsely equipped with play materials for the children. • In the Ladybird room, the edging of the ball pit was cracked and worn. • In the Cubs room, shelves and pieces of furniture were chipped at the edges. • Cushions and soft toys required cleaning and worn in appearance

1. The registered stated that they were working with the Better Start Quality Development Service to develop new interest areas. 2. The registered provider stated that the have removed damaged and worn equipment and materials and are working with the staff team to equip the shelving with equipment the children show an interest in. The registered provider stated that they plan to stock pile various equipment which can immediately replace worn, broken or torn equipment and materials. A washing checklist was developed to monitor the cleaning of cushions and soft toys
Regulation 22 — Food and drink
1. In the Messy Monkeys room, children could not access a drink of water independently. Their water bottles and cups were stored on a high shelf out of their reach. 2. The food was brought to the rooms in individually portioned plates or bowls; no additional food was served in the rooms to accommodate children who wish for a second portion

1. The registered provider stated that the children’s drinks are now stored on a low shelf to allow children to access them themselves. 2. The registered provider stated that staff have been made aware that extra portions of food can be requested from the chef, and crackers or rice cakes will also be available
Regulation 23 — Safeguarding health, safety and welfare of child
General Safety: 1. Floor mats in the Rocking Raccoon’s room were not secure and posed a trip hazard. 2. The service did not demonstrate compliance with the Early Years Inspectorate Regulatory Notice requiring services to renew Garda vetting every 3 years. While there were Garda vetting disclosures on file for all staff members, two of these vetting disclosures were not dated within the previous 3 years in adherence to the Early Years Inspectorate Regulatory Notice EYI-RN12.3 Renewal of Garda Vetting. 3. The low mirror on the wall of the Rocking Racoons' room was cracked, creating a risk of injury. Infection Control: 4. Some play equipment was torn, which prevented effective cleaning practices and posed a risk to infection control. For example, in the Caterpillar room, Ladybird room and the Butterfly room, the ball pools, the floor mats, and the material on the staff stool were torn. 5. The corner edging of the floor mats in the Caterpillar, Butterfly and Ladybird rooms had been replaced with non-wipeable material, posing a risk of cross-infection. 6. Soothers were not stored in airtight individual containers, creating a risk of cross-infection. 7. The door of the sanitary area in the Messy Monkeys room was latched to keep it open, which created a risk of cross-infection. 8. The children’s soft sofa in the Ladybird room was torn. 9. Nappy changing mats in the Cubs room and Penguin room were made of a fabric material and therefore could not be cleaned effectively. 10. There was no warm water available to support hand washing. Various hand-wash basins were checked throughout the premises during the day. 11. Staff did not change their aprons between every nappy change. 12. Cots were not placed 50cm apart, creating a risk of cross-infection. 13. In the sleep room one and the wobbler sleep room, mattresses were worn, with the foam visible. This prevents effective cleaning and is a risk of cross-infection
Safe Sleep: 15. Sleep room temperatures were not recorded while children slept. Through discussion with staff, the inspectors were not assured they were aware of the service policy to record room temperatures. Fire Safety: 16. Fire exits were blocked as this space was used for storage for children's beds and cleaning equipment, which may lead to delays in evacuating children during an emergency. An immediate action notice was issued, and the registered provider cleared the exits during the inspection. The inspectors made a referral to the Chief Fire Officer. General Safety: The registered provider stated the following 1. The floor mats in Rocking Racoons have been removed and ensure that new mats are not a trip hazard. 2. Garda Vetting for two staff members has been updated 3. The broken mirror in Rocking Racoons has been removed. Infection Control: 4. Torn play materials have been removed and replaced where possible 5. Floor mats have been removed and replaced with wipeable mats. 6. New soother pots have been obtained and staff have been trained to ensure these remain air-tight. 7. The doors to all sanitary areas are to remain closed, and staff have been made aware of this. 8. The soft sofa has been removed from the Ladybird room 9. New nappy changing mats have been acquired. Additional mats have been purchased to ensure they can be replaced timely manner if required. 10. The handyman regulated the warm water 11. A discussion has happened with staff regarding nappy changing practices. A member of management will spot check staff during nappy changes to ensure consistency of good practice. 12. Cot rooms have been rearranged to allow 50cm spacing. 13. Mattresses have been replaced. Safe Sleep: 14. Thermometers have been placed in each room, and staff have been reminded about the importance of all sleep checks. Management will be required to complete spot checks on the sleep records. Fire Safety: 15. An adequate response to the immediate action notice was received. All exits were cleared on the day of the inspection
Regulation 29 — Premises
d) The premises were not clean, maintained or repaired as required. The following was noted on inspection: • Throughout the building, ceiling tiles were missing or had holes in them. • The ventilation system was not working in the nappy changing area in the Caterpillar room. • Throughout the premises, there was grit and dirt build-up in corners and between furniture and fittings. • The electrical wires were not safely enclosed. Exposed wires were hanging loosely from the ceiling in the baby’s sleep room, in the Caterpillar room and in the main hallway • The children’s tables and chairs were worn, and the paint was chipped. • Throughout the rooms, there was paint chipped off the walls. • Shelving units were worn and scuffed with chipped paint. • The children's armchairs and adult chairs in the Messy Monkeys room were visibly dirty and stained. • Staff in the Messy Monkeys room stated that of the three toilets in the room, two are not used as the plumbing is not effective. • The gap between the nappy changing units and the steps had a layer of dust and dirt built up. • A tile was missing from the sink surround in the Cubs room. • Surfaces were not wipeable, which created a risk of cross-infection. For example, the internal window in the Messy Monkeys room had a masking tape on the window sill, preventing it from being cleaned effectively. • The timber radiator covers were broken in the Ladybird and cubs rooms. • The wooden play kitchen in the garden was not fit for purpose; the base was not secure, and the timber planks were broken. • In the Ladybird room, the adult chair was visibly stained and dirty, and the straps on the high chairs were dirty. • The paint and timber on the outdoor playhouse were chipped, peeling and splintered. • The roof of the outdoor toilet had a hole where the ventilation pipe should be, which would allow water to come through in the rain. (e) In the Penguin room, there were insufficient nappy changing stations to meet the number of children requiring nappy changing. Based on the number of children in the room, two nappy changing mats were required
