##### Regulation 21 — Equipment and materials

- There was a child size couch in the outdoor areas that was not in a good condition as it was torn and damaged

- : The person in charge has stated in the ir Corrective and Preventive Response (CAPA) form that: The couch was removed immediately from the outdoor area following the inspection. The service will ensure that all equipment and materials are to a proper standard for use

##### Regulation 23 — Safeguarding health, safety and welfare of child

- General Safety: Garda vetting was available for the six staff members employed in the service. However, the vetting disclosure for one staff member was not dated within the previous three years in adherence to with the Early Years Inspectorate Regulatory Notice ‘EYI-RN12.3 Renewal of Garda Vetting’. Action submitted by the Registered Provider

- : The person in charge has stated in the CAPA response form that General Safety: The Garda vetting renewal process for the one member of staff has been completed

##### Regulation 29 — Premises

- (d)There were areas on the premises that were not adequately cleaned, maintained and repaired. • The outdoors ground matting was unclean with dirt under and around the climbing frame and other permanent play fixtures. • The timber play fixtures appeared unkempt and in need of maintenance. • The all-weather ground surface matting was noted to have wide cracks starting from the playroom exit door down to the end of the outdoor play area. • There were areas on the wall of the bathroom lobby where it was not painted and maintained. Poorly maintained premises can pose a risk to the wellbeing and safety of the children and staff

- : The person in charge stated in the CAPA response form that: The service has contacted a local group to work on the maintenance and cleaning of the outdoor areas including the play and work equipment and materials. This work will be in progress over the coming months to get the identified areas to a better standard or replaced

##### Regulation 9 — Management and recruitment

- 1.No documented evidence was on file that all staff were appropriately supervised and provided with appropriate information, and where necessary training, including in relation to the following: (a) The policies, procedures and statements of the service specified in Schedule 5. (b) Part VIIA (inserted by section 92 of the Child and Family Agency Act 2013 (No. 40 of 2013)) of the Act, and (c) These Regulations. 2. There was no documented evidence that the staff received training on the services policies and procedures including the behaviour management policy since September 2020. It is acknowledged that the manager stated that unscheduled meetings took place each week with staff however records of these meetings were not available

- The manager has stated in the reply: 1. Staff meetings and one to one meetings will be documented. The meetings will have a set time each month and staff will be encouraged to discuss ideas, reflect on past events and plan for future events. 2. The service will ensure that staff will participate in training and in particular behaviour management

##### Regulation 10 — Policies, procedures etc. of pre-school service

- 1. The policies and procedures for the service have not been reviewed and updated since September 2020

- The manager has stated in the response that: 1. The service will ensure that the staff will be given the opportunity to review policies on a regular basis. The manager and staff plan to review the policies and procedures for the service this July before commencement on the preschool year in September 2024

##### Regulation 16 — Record in relation to pre-school service

- (k) The details of an incident which occurred in November 2023 involving a pre-school child attending the service was not recorded and not notified to Tusla, Early Years Inspectorate. This was at variance with the services Notification of Incidents Policy which stated that Tusla, Early Years Inspectorate would be notified within 3 working days of the incident and an accident and incident form would be completed and kept on file

- : The manager has stated in the response that: (k) The manager is now aware that any such incidents must be reported to Tusla within a period of 3 working days. Staff will renew their training on the relevant policies and procedures for the service

##### Regulation 31 — Notification of incidents

- (e) An incident in respect of a preschool child who was found alone and unsupervised occurred in November 2023 while a child was in the service. A notification of this incident was not completed and forwarded to Tusla, Early Years Inspectorate within the 3 working days. It is acknowledged that the parents of the child were informed and sent a notification of the measures the service had taken in relation to the incident to ensure a similar incident would not occur again

- The manager has stated in the response that: (e) The service is now aware that any such incidents must be reported to Tusla with 3 working days. Staff will update their training on the relevant policies and procedures for the service

##### Regulation 23 — Safeguarding health, safety and welfare of child

- Fire Safety: A fire drill for this September preschool year has not been carried out to date. Action submitted by the Registered Provider

- Fire Safety: The fire safety drill for September was completed the week following the inspection which was dated the 5th of October . Monthly fire drills will be completed. The service had discussions with staff on how to safely carry out fire drill particularly with the new children in the group

##### Regulation 26 — Fire safety measures

- (1)(b) There was no maintenance record available of the most recent servicing of the smoke alarm system for the service

- (b) The smoke alarm system is scheduled to be serviced in November 2023 by a reputable company. This will be done on a yearly basis going forward

##### Regulation 29 — Premises

- ( c) 1.The nappy changing unit located in a small modular unit in the outdoor area was cold and recorded 16 degrees which was below the recommended room temperature of 18 to 21 degrees Celsius. (d) The outdoor play area was poorly maintained and much of the wooden play equipment was in a poor state of repair. 2.The all-weather ground surface was unclean in many areas with dirt and moss accumulated particularly under the climbing frame. 3.Play equipment such as the wooden house the timber was broken and damaged with a nail visible. The paint work was chipped in many areas. 4. There was a broken storage box which posed a safety risk to the children and staff. (e) The nappy changing room was poorly maintained and untidy. 5.There was a hand operated bin for the nappies which posed the risk of cross infection to the staff. 6. There was no supply of paper towels to dry the hands after handwashing. 7.The nappy changing policy to guide the staff when changing a nappy was not visibly displayed

- ( c) 1.The heater will be turned on to ensure the temperature in the nappy changing unit is between 18 to 21 degrees Celsius and this will be checked regularly to maintain the correct room temperature. (d) 2.Weeds in the outdoor surface were removed and outdoor surface was swept. Outdoor surface will be cleaned and tidied up. 3.The wooden truck was dismantled, and all broken wood was taken away from the service. 4.The broken storage box was removed from the area. (e) Nappy changing unit is being maintained and tidied and a new nappy changing bed was obtained. 5.The hand operated bin was removed and replaced with a pedal operated bin for nappy changing. 6.Paper towels are now in place. 7.The nappy changing policy is visibly displayed for staff
