#### Inspection of 7 April 2026 — Inspection Report

**Immediate action notice.** Corrective & Preventive Action submitted by the Registered Provider Corrective and Preventive Action (1) The Change of Circumstance Form relating to the change in Person in Charge has now been completed and submitted. The Registered Provider has reviewed all current governance and compliance documentation to ensure all prescribed information held by Tusla is accurate and up to date. A formal review meeting was held with senior management to address the non-compliance and reinforce regulatory obligations under the relevant regulations. Responsibility for all statutory notifications has now been formally assigned to a designated member of senior management with oversight by the Registered Provider. ##### Regulation 19 — Health, welfare and development of child

- 1. Staff in the Snuggle room did not change a child’s wet top in a timely manner despite interacting with the child during this time. This did not ensure a comfortable experience for the child

- 1. Staff were reminded of their responsibility to ensure children’s personal care needs are responded to promptly and sensitively at all times. A review of room routines and staff deployment within the Snuggle Room was undertaken to ensure children’s care needs can be identified and responded to without delay. The Person in Charge conducted observations within the room to ensure appropriate standards of care and responsiveness were being maintained. The issue was discussed at a staff meeting to reinforce expectations regarding children’s dignity, comfort, and wellbeing. Refresher training will be provided to all staff on responsive caregiving, children’s wellbeing, and maintaining children’s comfort and dignity throughout the day. Daily room checks and observations by room leaders and management will be strengthened to monitor the quality of interactions and care practices. Personal care procedures will be reviewed with staff to ensure there is a consistent understanding of expectations regarding timely changing of wet or soiled clothing. Reflective practice sessions will be incorporated into regular supervision meetings to support staff awareness of children’s emotional and physical wellbeing needs. Management will continue to monitor practice through ongoing audits and unannounced observations to ensure sustained compliance and quality improvement

##### Regulation 23 — Safeguarding health, safety and welfare of child

- General Safety: 1. Seven children aged between 1 ½ to 2 years were observed not to be securely seated in the highchairs provided during mealtimes. Of the nine highchairs observed to be used, six highchairs did not have the safety staps secured and one highchair did not have any safety straps to be secured. This practice was not in line with the highchair manufacture guidelines. This posed a potential risk of injury. 2. Chairs were observed to be stacked in a hazardous position in the Boo Boo Bear room where two children aged between 1 to 2 years played. The inspector observed chairs to be stacked in groups of three and four. This posed a potential risk of injury. A similar non-compliance was observed on the previous inspection, and the preventive action had not been sustained. Infection Control: 3. The mattress protective covers used on the five cots in the Boo Boo cot room were not waterproof. This posed a risk of cross infection as the cot mattresses used were not waterproof. Safe Sleep: Sleep practices were not in line with the service safe sleep policy or the safe sleep guidelines developed by Tusla. The following practices were observed: 4. Children under two years old were not provided with a suitable floor bed with a mattress depth of at least 6cm. 5. Individual sleep plans which are a requirement for children under two years of age who are not provided with a cot for sleeping were not adequately completed. Evidenced by the following: o Three of the five children observed to be sleeping on low mats did not have an individual sleep plan available. o Five of the individual sleep plans in the Teddy Bear room and two of the individual sleep plans in the Snuggle Bear room did not include a parent signature. In addition, one of these plans did not detail if the child is developmentally ready to make the transitions from a cot to a suitable floor bed completed. Sleep plans should include an assessment of the individual child’s sleep routines and sleep requirements, to be determined and agreed in collaboration with parents/guardians and consideration of the child’s developmental readiness to move from a cot to a floor bed. 6. The staff member in the Boo Boo Bear room did not complete physical sleep checks while four children aged between 1 to 2 years old slept. The staff member was observed to open the cot room door and look in momentarily from the care room. It is important that sleep checks are carried out from a position that the adult is able to observe the breathing, position, and colour of each child. This posed a potential risk of safety. Action submitted by the Registered Provider

- General Safety: 1. The highchair identified as missing safety straps was removed from use immediately. All remaining highchairs were inspected to ensure they were in good working order and fully compliant with manufacturer safety requirements. All staff were immediately instructed that safety straps must be secured for every child seated in a highchair at all times. Room leaders conducted immediate safety checks during mealtimes to ensure compliance. A daily equipment safety checklist has been implemented to ensure all highchairs and safety equipment are checked before use. Staff have completed refresher training on mealtime supervision, risk management, and safe use of equipment. Management will conduct regular spot checks and audits during mealtimes to ensure consistent compliance. Safe mealtime practices will be reviewed regularly at team meetings and incorporated into induction training for new staff. 2. Chairs were immediately removed and stored safely away from children’s access. Staff in the room were reminded of safe storage procedures and the importance of maintaining hazard-free play environments. A full environmental risk assessment was completed within the room. A revised storage procedure has been introduced outlining safe storage requirements for furniture and equipment. Daily room safety inspections have been strengthened and documented by room leaders. Management will complete unannounced health and safety audits to monitor ongoing compliance. The issue will continue to be monitored through supervision and governance meetings to ensure sustained improvement. Infection Control: 3. Waterproof protective covers have now been purchased and fitted to all cot mattresses. All sleep equipment was reviewed to ensure compliance with infection prevention and control requirements. An infection control equipment audit schedule has been introduced to ensure all sleep equipment remains compliant and fit for purpose. Staff have received refresher guidance on infection prevention and control practices. Management will review equipment inventories quarterly to ensure replacement items are sourced promptly where required. Safe Sleep: 4. Appropriate sleep mats and mattresses compliant with Tusla guidance are being sourced. Existing unsuitable sleep equipment was removed from use. A full review of all sleep environments and equipment has been completed. Safe sleep compliance checks have been incorporated into daily opening and closing room checks. Management will conduct regular audits of sleep equipment to ensure ongoing compliance. 5. All Children under two years of age now have completed individual sleep plans in place. Parents/guardians were contacted immediately to review, update, and sign all sleep plans. Sleep plans were reviewed to ensure developmental readiness assessments and individual sleep requirements were clearly documented. A standardised sleep plan review process has been implemented to ensure all plans are completed fully prior to a child transitioning to a floor bed. Sleep plans will now be reviewed with parents at regular intervals and whenever there is a developmental change. Management will complete monthly audits of all sleep plans to ensure documentation remains current and complete. Staff have received refresher training on Tusla safe sleep guidance and documentation. 6. Staff were immediately reminded of the requirement to complete and document direct physical sleep checks in accordance with the service policy and Tusla guidance. Sleep supervision practices were reviewed immediately with all staff members. Management conducted direct observations of sleep practices following the inspection. Refresher training on safe sleep supervision and sleep check procedures has been provided to all staff. A revised sleep monitoring procedure and recording system has been implemented to support consistent practice. Room leaders and management will carry out regular observations and audits of sleep practices to ensure compliance is maintained. Safe sleep practices will remain a standing agenda item at staff meetings and supervision sessions

#### Inspection of 30 July 2025 — Inspection Report

**Immediate action notice.** Two Immediate Action Notices were issued to the registered provider on the day of the inspection under Regulation 23, in relation to non-compliances identified under Regulation 23. A response was received from the registered provider which mitigated the risk identified. See body of report for details.

##### Regulation 9 — Management and recruitment

- (7) (a) Of the 7 staff from whom documentary evidence of support and supervision was requested there was no documentary evidence available for 2 staff members of support and supervision, or appraisal records who had been employed beyond a year. Staff require ongoing support and supervision to effectively follow service policy and procedure. This is not in line with service policy that advises management will have regular meetings with staff and that a written support and supervision record of those meetings will be recorded and signed by both parties. In addition, service policy advises appraisals are carried out including giving feedback of the work of the year and a record signed by both parties is kept

- Management complete support and supervision meetings for all staff members regularly and record every meeting. We have assigned for our creche managers to conduct these meetings and to print and file them to be left in their office, onsite for any future Tusla inspections as proof of same

##### Regulation 19 — Health, welfare and development of child

- 1. The height of furniture was not suitable for the age ranges present in the Teddy Bears room. Children were observed with their feet not reaching the floor and the table at chest height. This reduced the comfort and ease for children to engage with tabletop activities and mealtimes. 2. The layout and limited availability of supporting resources in themed areas reduced children’s opportunity to engage in extended play opportunities. This was evidenced by the following: • Dolls in the Boo Boo Bear room had no supporting resources such as clothes or prams to encourage play. • A shelving unit at the children’s level in the Teddy Bear room had no resources. • The washing machine in the Teddy Bears room had no supporting resources for play. Service policy advises children’s play is encouraged with the presence of household items and real-life resources, this was not observed on the day of inspection. • Books in the Teddy bear room library were observed torn and damaged which did not promote the use of the library area for early literacy. • A heavy box containing large wooden blocks was stored on top of another toy which prevented ease of access in the Teddy bear room
- 3. A child was placed into a cot while wearing shoes and remained in their shoes during nap time. This did not support a comfortable experience for the child
- 4. The approach used by an individual staff member during interactions with children was not observed to be child friendly or in line with service policy which could potentially led to unpleasant experiences for children. The following was observed: • The staff member was observed to correct a child’s behaviour while positioned behind them using a harsh tone and poking a child in the shoulder. Service policy advises staff will support positive behaviour using a calm tone of voice, getting down to the children’s eye level, waiting and checking for the child’s understanding. This practice was not observed at the time of this interaction. • The staff member was observed to restrict a child from using their hands during mealtime and attempting to insist on the use of cutlery, putting the cutlery into the child’s hand. This can limit the child's sensory experiences during important learning opportunities such as mealtimes. This is not in line with service policy that advises children are allowed to use their fingers to eat their food and help to feed themselves. It is acknowledged another staff member interjected to support the child. • The staff member did not respond appropriately to a child’s communication cues indicating frustration while the staff member tried to place a bib on. It is acknowledged another staff member interjected to support the child

- 1. Since the inspection, we have assured that all chairs are the lower height to ensure that shorter children can reach the floor. There are currently no children registered in this room, but we will have the correct height chairs for the next age group that will be in this room. 2. Additional resources were purchased, damaged resources were replaced and the heavy block box places in a safe, accessible storage area at children’s level. Room Leaders will regularly review play areas to ensure resources are stocked, safe, and in good condition. Management will replace or repair damaged resources promptly. Staff have been trained on maintaining and rotating resources to encourage extended play
- 3. The child’s cot sheet was washed following their sleep to ensure good hygiene practice. If a child becomes upset about removing shoes in the future, we will speak with the parents to inform them that Tusla require us to remove the shoes of a child before sleep time
- 4. This non-compliance has been created as a complaint and escalated further. Since this has been brought to our attention we have spoken to every member of the team and retrained them in our policies and procedures and our mission statement. All members have also received retraining regarding child safeguarding

##### Regulation 23 — Safeguarding health, safety and welfare of child

- General Safety: 1. A child aged under 3 years old present in the service was observed wearing amber bead jewellery. This is in breach of the Early Years regulatory notice on Amber bead Teething Jewellery issued October 2024 which outlines the decision of the early year’s inspectorate; Amber bead jewellery is prohibited for use in early years services for children under three years of age. This posed a significant safety risk, and an immediate action notice was issued, a response which mitigated the risk was received on 31 July 2025. 2. Windows of the Boo Boo Bears and Buddy Bears rooms were observed fully open and not restricted with the use of the safety latch. Both windows in the Boo Boo Bears and one window in Buddy Bears have a bench style windowsill easily accessible to children. The second window in the buddy bears room had furniture placed underneath making the open window accessible. This posed a potential risk of injury from children falling from the ground floor window onto the gravel and grates below. 3. Cleaning agents were observed accessible to children as they were stored in a low-level press with a broken safety latch which posed a potential risk of accidental poisoning. This non-compliance was observed on the previous inspection in February 2025. The preventive action has not been carried out in line with the information provided to the inspectorate following the last inspection. 4. A trailing flex from decorative lights was accessible to children in the Teddy bear room which posed a potential risk of injury. A similar non-compliance was observed on the previous inspections in February 2025 and August 2023. The preventive action has not been carried out in line with the information provided to the inspectorate following the last inspection. 5. Furniture was observed to be stored in hazardous positions, posing a risk of injury. Evidenced by the following: • As children played in the Snuggle bear room chairs were stacked in groups of six and eight. • Furniture including tables and chairs were observed stacked in the Polar Bear room while children were present in the room. Children were observed attempting to play with items stored on the stacked furniture. • A tall storage unit present in the hallway outside the Boo Boo bears room was not fixed to the wall. A similar non-compliance was observed on the previous inspection in February 2025. The preventive action has not been carried out in line with the information provided to the inspectorate following the last inspection. 6. An ambient temperature of 18-22℃ was not maintained in rooms were children over the age of one were playing which posed a potential risk to children safety. The following was observed: • Snuggle bears room was 24.7℃ at 11.56am • Buddy Bears room was 24.6℃ at 11.24am Infection Control: 7. Perishable food such as yoghurt and sausages brought by the children from home for morning snack time were not stored in a fridge, this increases the risk of bacteria multiplying to levels which could result in illness in young children. This non-compliance was observed on the previous inspection in February 2025. The preventive action has not been carried out in line with the information provided to the inspectorate following the last inspection. 8. Children in the Snuggle Bear room were not supported to wash their hands before mealtime. This is not in line with HPSC guidelines. Safe Sleep: 9. An ambient temperature of 18-22℃ was not maintained in rooms were children over the age of one were sleeping which posed a potential risk to children safety. The following was observed during sleep times: • Snuggle Bears room was 25.8℃. Temperatures of this level can place an increased significant risk to children’s safety to heat related illnesses. An immediate action notice was issued and a response which mitigated the risk was received on 31 July 2025. • Boo Boo Bears cot room was 23.8℃ • Polar Bears room were children from Teddy Bears room slept was 24.3℃. 10. Sleep room temperature records were not completed for the Snuggle Bears room or cot room 2 on the day of inspection. A review of available records demonstrated that no sleep temperature record had been maintained for the Snuggle bears room since Wednesday 23 July. This is not in line with service policy that advises temperatures will be recorded regularly throughout sleep times. The practice and recording of temperatures help to provide a safe sleep environment for children. Fire Safety: 11. Attendance records were not maintained in a timely manner which posed a potential risk of hindering safe evacuation from the premises in the event of an emergency. It could not be accurately established the number of children on the premises at this time. The following was evidenced by the following: • At 11.46am 3 children who were present in the Snuggle Bears room were not signed in. • At 10.44am 3 children who were present in the Buddy Bears room were not signed in. • At 11.43am a child who was due to go home at 12.00pm was observed already signed out of the roll book. Action submitted by the Registered Provider

- General Safety: 1. All amber teething necklaces and similar items were removed from use within the service immediately. A written notice was issued to all parents on the 31st July informing that amber jewellery is prohibited due to safety concerns. The service jewellery policy was updated. 2. Windows are now all kept on the safety latch. Staff have been advised by management to ensure all window are kept on the safety latch. 3. Staff have been retrained to store this spray bottle in their top shelf only which is out of reach of all children. 4. Management have removed all wiring from all rooms that were within reach of children. All staff have been made aware that no wiring can be allowed in their rooms that is in reach of children. All high-level wiring has now been fixed with a clip to the wall to ensure that even if it were to release that it could not get into the hands of any child. 5. Staff received training and now know not to stack any furniture in any room. 6. New cooling fans were purchased and installed which reduced the temperature. Temperatures will be monitored. Infection Control: 7. We have communicated to parents to advise them that we can no longer allow food to be brought to creche from home (outside of ECCE classes). We issued parents with advice on alternative non-perishable, healthy and nutritious foods suitable for a snack for ECCE classes only. Parents and staff have been reminded that food cannot be accepted from home (outside of ECCE lunchbox only). 8. All staff have been reminded that children must wash their hands before meals. Hand hygiene posters on display in each care room to remind staff that hand washing before meals/snacks is mandatory. Management will carry out monthly hygiene practice audits to confirm compliance. Hand hygiene is reinforced in staff induction and refresher training. Safe Sleep: 9. Windows and doors were opened to improve air circulation the sleep room was temporarily not in until the temperature returned to a safe level. Children scheduled for sleep were moved to a cooler well- ventilated space under supervision. New cooling fans were purchased and installed. 10. Management reminded staff of the importance of recording sleep room temperatures. Temperature recording resumed immediately for sleep rooms. Management will conduct regular checks of sleep room records. Fire Safety: 11. All staff were reminded that all attendance records must be recorded in real time when children arrive and leave. We conducted a fire drill to demonstrate the importance of accurate recording. Staff have been retrained on our Attendance Policy and the importance of accurate timekeeping. Attendance record checks have been added to our daily checklist

##### Regulation 9 — Management and recruitment

- (3) The registered provider did not ensure the following checks were carried out prior to one adult working in the service. o One staff member did not have the two references validated before they commenced employment

##### Regulation 16 — Record in relation to pre-school service

- (1) (j) The registered provider did not ensure that there was an accurate record of administration of medication records. Evidenced by the following. o A sample of ten records were reviewed. Three records were not completed in full: two records did not include the children's full name and date of birth while one record did not include a child’s date of birth

- Management have included surname and DOB in all administration of medication forms. Staff have been informed of this change and explained of the importance of including this information in every form

##### Regulation 19 — Health, welfare and development of child

- 1. On the day of the inspection, it was observed that one child’s basic needs were not met. Evidenced by the following. • A child was observed to be left in a wet top that was not promptly changed by staff. Wet clothes can cause a child to feel discomfort. A similar non-compliance was observed on the previous inspection in August 2024 and the preventive action had not been sustained. 2. Mealtime practices in the Buddy Bear room did not support the children to engage in a timely and enjoyable dinner. The following was observed. • The dinner arrived in the room at 11.38am however the children were not served their meal until 12.13pm. By feeling the outside of a dish, the inspector confirmed the food was no longer warm when served. • Eight of fourteen children present in the room for dinner did not eat the main meal. Although an alternative hot meal was available it was not offered to the children, four of whom were observed to eat items from their lunch boxes sent from home. An alternative hot meal should be offered to children who refuse the meal offered. 3. The book area in four of the care rooms were observed to be poorly resourced. There were limited books available and some of the books available were observed to be torn and not in good repair. This inhibited the children’s reading experience. 4. Three out of the four battery operated toys in the Boo Boo Room were not working. Cause-and-effect toys help promote joint attention, play skills and exploration. This limited the children’s play experience. 5. There were no art resources available at labelled art areas in the Buddy Bear and the Snuggle Bear room. This limited the children’s creative experience

- 1. Staff have been trained to identify children’s needs and act accordingly. Staff and management has been trained to reassure all children’s needs are met in a timely manner. There will be refresher training every three months. 2. Management have corrected cooking and serving times, so the children get the food at the right temperature in a timely manner. Also, there will be an alternative hot meal in case the children don’t want the first option. Management have also implemented a system where the teachers will advise when the children are ready to get the food, so managers know when to serve it. 3. Management have renewed all the books in every classroom and removed all the books that weren’t in a good condition. Teachers will remove anything that gets broken straight away and they will order a replacement with the manager. 4. Management have provided new batteries and made sure everything is working in the room. Teachers have now extra batteries in the art press in the hall so they can replace them themselves. 5. Management have provided more art resources to the teachers. The service has linked with a government quality support agency to help the teachers to maintain certain areas and learn more about it

##### Regulation 23 — Safeguarding health, safety and welfare of child

- General Safety: 1. Cleaning agents were observed to be stored in a press under the sink in the Snuggle Bear room. The safety lock on this door was not working which made them accessible to children and posed a risk of injury to children. 2. There was a trailing flex accessible to children observed in the Teddy Bear room. This posed a risk of injury. A similar non-compliance was observed on the previous inspection in August 2023 and the preventive action had not been sustained. 3. There were no visibility strips on full length window in the Cub Bear room. This posed a risk of injury. This non-compliance was observed on the previous inspection in August 2023 and the preventive action had not been sustained. 4. Chairs were observed to be stacked in hazardous positions, posing a risk of injury. Evidenced by the following: • There were five chairs stacked on top of each other in the Boo Boo room. • There seven chairs stacked on top of each other in the Snuggle Bear room. • There were eight chairs stacked on top of each other in the Buddy Bear room. • There were ten chairs stacked on top of each other in the Teddy Bear room. 5. The plastic caterpillar tunnel in the outdoor play area was damaged and the plastic was observed to be cracked. This posed a risk of injury Infection Control: 6. Nappy changing and handwashing was observed to be at variance with the service infection control policy and was not in line with best practice. Evidence by the following. o Three children were observed to have their hands cleaned with wipes and did not have their hands washed following nappy changing. o A staff member was observed to use a hand sanitiser and did not wash their hands following the nappy changing of three children. o A staff member was not observed to disinfect the nappy changing mat after each nappy changing procedure. Three nappy changing procedures were observed. o Staff were observed to use hand wipes instead of washing the children’s hands with warm water and soap in one of the care rooms before dinner time. Similar non-compliances were observed on the previous inspection in August 2023 and the preventive actions had not been sustained. 7. Perishable snacks such as yoghurt and ham brought by the children from home for morning snack time were not stored in a fridge, this increases the risk of bacteria multiplying to levels which could result in illness in young children. 8. The fabric on a chair in the Teddy Bear room was observed to be torn with the foam exposed. This posed a risk of cross infection. 9. There was no foot pedal operated bin in the Buddy Bear room sanitary area. This did not allow for hygienic disposal of contaminated materials and posed a risk of cross infection. Fire Safety: 10. The attendance of the children was not accurately recorded on the attendance record log in one of the care rooms. Evidenced by the following. o A child observed to go home at 10.30am was not marked out in the attendance book until 11.30am. o On review of the attendance book the inspector noted that four children had not been marked out from the previous day. This reduced the effective evacuation in the event of an emergency. Action submitted by the Registered Provider

- General Safety: 1. Management have fixed the press in Snuggle Bears Room. Management have employed a handyman that will work on an on-call basis, so he can repair everything in a short time. 2. Management have removed all cables from the rooms. Staff can now charge the tablets in the office. Every afternoon before closing time, staff will bring the tablets to charge in the office. This system will help avoid accidents and ensure tablets are always ready to use. 3. Management have corrected this immediately by purchasing and sticking the visibly strips in Cub Bears window. Management have given the staff plenty of them so they can re install them if they fall off. 4. Teachers are not allowed to stack chairs anymore. Management have trained and explained to teachers the risk of stacking chairs. 5. The broken piece of the caterpillar has been removed by the service’s handyman. The new handyman will check with the managers of the creches, and a snag/repair list will be sent weekly. Infection Control: 6. Teachers were retrained in the Infection Control Policy. There will be training every 3 months and internal inspections will be carried out. 7. Perishable snacks won’t be allowed on the premises. Management have informed parents of this change and remind them of our healthy eating policy. Examples of healthy snacks for the lunchboxes are available on service website. 8. Management have purchased a new cover for that chair. Teachers will get rid of anything that gets broken straight away and they will order a replacement with the manager. 9. Management have changed the bin in Buddy Bear Room for a pedal bin. Teachers and managers have been retrained in the Infection Control Policy. Fire Safety: 10. All staff and management have been retrained in fire and evacuation policy and it has been explained again the correct procedure and importance of the attendance books being accurate. ##### Regulation 25 — First aid

- (1) On review of the staff roster, it was observed that the one staff member with First Aid Responder (FAR) training was not available to the children at all times. It is acknowledged that four staff members rostered hold a first aid qualification and the inspection team were shown evidence that staff members are provisionally booked to undertake FAR training

- (1) Three staff members now have their FAR course completed. Management will make the rosters around the staff with the FAR Cert so there’s always someone with FAR on the premises
