##### Regulation 9 — Management and recruitment

- (3) Documentation reviewed showed that one adult commenced work in the service prior to receipt of Police vetting. The adult commenced work in the service on 1 December 2025 and Police vetting was obtained on 12 December 2025. While it is acknowledged that a risk assessment was completed during the waiting period, no adult should commence working directly with children until vetting has been received to ensure they are suitable to undertake such work

- (3)A strict policy has been reinforced across the service that no staff member may commence work in any capacity involving access to children until Garda/Police Vetting has been fully received and verified and management have been retrained on the regulatory requirement. A pre-employment compliance policy has been implemented, the recruitment process has been revised and a monthly audit of staff files has been implemented to ensure ongoing compliance and early identification of any gaps

##### Regulation 23 — Safeguarding health, safety and welfare of child

- Infection Control: 1. There was no pedal‑operated bin available in the outdoor area. The bin available for disposal of waste was open top, requiring direct hand contact when managing waste posing a risk of the spread of infection. 2. Vinyl seating and a cushion in the children’s rest area in the Montessori room were observed to be torn exposing the inner foam. The foam material is porous and cannot be effectively cleaned, posing a risk of the spread of infection. Action submitted by the Registered Provider

- Infection Control: 1. A new pedal operated bin has been purchased and is now in place in the outdoor area and all staff have been reminded of infection control procedures, including proper waste management and hand hygiene practices. 2. The damaged vinyl seating and cushion in the Montessori rest area have been removed and replaced with fully intact, wipeable, non-porous materials that can be effectively cleaned and disinfected in line with infection control standards. A regular environment and equipment inspection schedule has been implemented to identify and address wear and tear promptly

##### Regulation 9 — Management and recruitment

- (d) Police vetting was not available in relation to one staff member who previously lived outside of the State for a period of more than 6 months as an adult. This requirement was non-compliant on previous inspections dated 30 June 2017,21 January 2020, 30 May 2022, and 27 February 2024. The actions submitted by the registered providers following each inspection had not been effective in preventing the non-compliance from reoccurring. (3) Documentation reviewed evidence that the procedures specified above under 9(2)(d) had not been carried out prior to one adult commencing employment in the service

- (2)(d) (3) Evidence of police vetting was submitted for the staff member. A full internal audit of all current staff records was completed to ensure police vetting is in place for all relevant staff. A compliance tracking system has been implemented to log each staff member’s vetting status, highlighting deadlines for any international vetting requirements. The recruitment policy has been updated to strictly prohibit commencement of employment prior to receipt of all required vetting documentation. Staff members responsible for the recruitment process have undergone training with regards to the requirements of regulation 9 (2) (d)(3). A mandatory pre-employment checklist has been introduced, which must be fully signed off by management before a new hire can start. This includes a section for verifying international vetting if relevant. Quarterly compliance checks have been scheduled to ensure continued adherence to all vetting requirements and prevent future oversights

##### Regulation 16 — Record in relation to pre-school service

- (k) The service uses a triplicate accident and incident book to record incidents involving the children, the inspectors reviewed thirty-four records and found that five forms were not signed by the parents, four of which still contained the parents copy. Failure to provide parents with information regarding incidents involving their child could potentially impact follow up care at home

- (k) Parents were informed of the incidents and signatures were obtained retrospectively. A full review of accident and incident logs has taken place and a protocol is now in place requiring same day sign off at collection. Room leaders will verify that all forms are signed and distributed daily. Staff received refresher training, and the triplicate form is now under review to ensure clarity and to support consistent completion and parent acknowledgment

##### Regulation 23 — Safeguarding health, safety and welfare of child

- General Safety: 1. A cable from an air conditioning unit in the sleep room shared by Senior and Junior Pre Wobbler children was found to be sitting in water that had leaked from the unit presenting an electrical hazard. Although the morning risk assessment was documented as completed and indicated the floor was clean and dry, staff confirmed it had not been checked that morning and was last inspected on Friday evening. The issue was brought to the attention of the person in charge and appropriate action was taken to mitigate the risk. There were no children sleeping in the cot room during this time. 2. A trailing cable from an air conditioning unit stored on a shelf was observed to be hanging down above a soft play area in the Senior Pre Wobbler room posing a potential risk to the safety of the children. The issue was brought to the attention of the person in charge and appropriate action was taken to mitigate the risk. The service was found to be non-compliant for trailing cables on the previous inspection dated 27 February 2024. The preventive actions submitted following this inspection has not prevented the non- compliance from recurring. Infection Control: 3. A large vinyl fabric mat in the Senior Pre Wobbler room was found to have a tear on the surface exposing the internal foam. The exposed area posed an infection control risk, as the surface cannot be effectively cleaned or sanitised. Action submitted by the Registered Provider

- General Safety: 1. The leaking air conditioning unit was replaced with a new unit. 2. The trailing cable above the soft play area was secured and repositioned to eliminate risk. All air conditioning units and their associated wiring were assessed and made safe by a maintenance contractor. Risk assessments for all rooms were immediately reviewed and updated where needed to reflect additional hazards associated with electrical units and cables. Room leaders must now sign off a physical walk-through checklist at the start of each day. Infection Control: 3. The torn vinyl mat was removed from the room and a deep clean of the area was carried out. A new vinyl mat is now in place. Staff in the Senior Pre Wobbler room were reminded of the importance of daily checks on all soft furnishings and play equipment. A daily inspection log is now in place in each care room and monthly audits of soft furnishings will now take place

**Immediate action notice.** Immediate Action Notice - Part III - Management and Staff

**Immediate action notice.** Regulation 9(2)(c): An Immediate Action Notice was issued on 28 February 2024 as a mandatory Garda vetting disclosure was not available for one person who was present in the service contrary to the National Vetting Bureau (Children and Vulnerable Persons) Act 2012. A response was received from the registered provider on 28 February 2024 outlining actions taken to address the risk. These are documented under regulation 9(2)(c) in the report.

**Immediate action notice.** Immediate Action Notice - Part VI – Safety Regulation 23: An Immediate Action Notice was issued on 28 February 2024 due to the significant risks posed in relation to safety. A response was received from the registered providers on 28 February 2024 outlining actions taken to address the risk. These are documented under regulation 23 in the report. Inspection Findings Review The registered providers requested a review of inspection findings under regulations 9(2)(a), (b), (c) & (d) and (4). The inspection findings review concluded on 15 May 2024.

##### Regulation 9 — Management and recruitment

- (2) The registered providers did not ensure that all employees and unpaid workers were suitable and competent to work with children as outlined. (a) & (b) No references had been sourced for three students who were present on a third level work experience placement. References were not available from the most recent past employer of two staff members who had been employed since the previous inspection. This requirement was non-compliant on previous inspections dated 9 May 2023, 25 July 2022, 30 May 2022, and 21 January 2020. The actions submitted by the registered providers following each inspection to address non-compliance had not been effective in preventing the non-compliance. (c) A Garda vetting disclosure was not available for one student who was present on a third level work experience placement. The operations manager told the inspectors that the service had not received Garda vetting and were aware that the person should not be present without this. The operations manager arranged for the person to be collected from the service during the inspection. An immediate action notice was issued on 28 February 2024 due to the significant risk posed. This requirement was non-compliant on previous inspections dated 9 May 2023, 25 July 2022 and 30 May 2022. The actions submitted by the registered providers following each inspection to address non-compliance had not been effective in preventing the non-compliance from re-occurring. (d) Police vetting was not available from the states in which three staff members had lived for more than six months as an adult. Two of the staff members had been employed since the previous inspection. This requirement was non-compliant on previous inspections dated 30 May 2022, 21 January 2020, and 30 June 2017. The actions submitted by the registered providers following each inspection had not been effective in preventing the non-compliance from re-occurring. (4) There were no records to evidence that two staff members employed to work directly with children held the required minimum qualification. One of the staff members had been employed since the previous inspection. This requirement was non-compliant on previous inspections dated 9 May 2023, 25 July 2022, 30 May 2022, 21 January 2020, and 30 June 2017. The actions submitted by the registered providers following each inspection had not been effective in preventing the non-compliance from re-occurring

- 2(a) & (b) Verification phone calls were made to the schools of the students. A new file checklist for students has been created and will be followed for all new students doing work experience. The service has purchased a new reference check booklet. All management have been trained and signed off on the process. (2)(c) The student will not be on the premises until all required documentation is complete. (2)(d) Police vetting for one staff member was submitted to the inspectorate on 28 February 2024. An application has been made to receive police vetting for the second adult. Police vetting for the third adult is in process. A new staff file checklist has been created and will be followed for all staff going forward. All management have been trained and signed off on the process. Service policies on vetting requirements have been updated by management. (4) Two staff members are currently completing their course. The service will hire qualified staff in future

##### Regulation 19 — Health, welfare and development of child

- 1. The inspector observed that suitable care practices were not in place in the Pre-Wobbler room at mealtime. The mealtime was observed to be rushed. Adults sat with the children for a short period only. Some of the children’s bowls of food and one child’s drink were taken away before they had finished. The inspector observed the children showing signs that they wanted more food including reaching into other children’s bowls and eating food that had been spilled onto the table. 2. The inspector observed that appropriate care was not taken to clean mucus secretions from children’s faces in the Wobbler room. The inspector observed two children with large mucus secretions which were not cleaned in a timely manner. One of the children’s faces was not cleaned until 30 minutes after this was observed by the inspector, despite having had one-to-one attention from a staff member during this time. This regulation was non-compliant on previous inspections dated 9 May 2023, 25 July 2022 and 30 May 2022. The actions submitted by the registered providers following each inspection had not been effective in preventing the non-compliance from re-occurring

- 1. The service has introduced a new process for mealtime to ensure a smooth enjoyable lunch time for all children. New times for eating have been introduced for the room. Staff members have been allocated to each table during eating time. Staff have been retrained to make sure children have finished eating before anything is removed from the table. This routine will be reviewed weekly to ensure an enjoyable lunch experience for all children. 2. All staff have been re-trained in this area and this will be included in all staff training and spot checks going forward

##### Regulation 23 — Safeguarding health, safety and welfare of child

- General Safety: 1. Plastic bags used for storing children’s bed linen were accessible to children posing a risk of suffocation. When children were being prepared for sleep, the bags were stored in an open basket on the floor of the Pre-wobbler room. The inspector observed a child put one of the bags over his head. It is acknowledged that a staff member immediately removed the bag from the child’s head, however the bags remained accessible to the children. The inspector observed that the bags were then placed in the open basket next to a cot where a child was placed to sleep. 2. Loose cables were not secured out of reach of children, posing a risk of strangulation. Inspectors observed cables from electrical equipment within reach of children in the Pre-Wobbler room, Wobbler room, Toddler room, Pre-Montessori room and both cot rooms. An immediate action notice was issued to the registered providers on 28 February 2024 due to the significant risk posed to children’s safety. This regulation was non-compliant on previous inspections dated 9 May 2023, 25 July 2022 and 30 May 2022. The actions submitted by the registered providers following each inspection had not been effective in preventing the non-compliances from re-occurring. Action submitted by the Registered Provider

- General Safety: 1. All plastic bags for sleep clothing have been removed from the premises. New netted bags were purchased for sleep wear. Spot checks multiple times throughout the day for hazards. 2. Loose cables have been secured to the wall using wall ties. Where possible equipment has been removed.
